"آزادی از دیدگاه امام خمینی دکتر محمدصادق محفوظی الف)حقوق فردی و آزادیهای عمومی در اسلام از دیرباز این عقیده وجود داشت که یک سری از حقوق در میان بشر معمول است که از همه قواعد و مقررات رجحان و برتری دارد و ریشه آنها در فطرت و طبیعت انسان است و نیازی به وضع و قرارداد ندارد،بلکه از لوازم طبیعی انسانیت است و آن متقن و تغییرناپذیر است و این چیزی نیست که به تازگی پدید آمده باشد،بلکه افلاطون و ارسطو و نیز بسیاری از فلاسفه و روشنفکران یونان دارای اندیشه حقوق فطری بودهاند و این همواره در میان جامعه مطرح بوده است؛منتها بنیاد آن در میان ملل باستانی شکل گرفت و در قرون وسطی توسط حقوقدانان کلیسایی رنگ مذهبی به خود گرفت و در قرون هفده و هیجده میلادی از سوی حقوقدانانی مثل جان لاک،روسو و منتسکیو و دیگران به گونهای مطرح شد که بعدها در میان همگان به عنوان پدیدهای ضروری و بدیهی درآمد.
امام(ره)که همواره خدمت و توجه به مردم را از وظایف اساسی مسؤولان و کارگزاران حکومت اسلامی دانسته و رضایت خداوند را نیز در آن میدیدند،در فرمان هشت مادهای خطاب به قوه قضائیه و تمام ارگانهای اجرایی میفرمایند: «باید همه بدانیم که پس از استقرار حاکمیت اسلام و ثبات و قدرت نظام جمهوری است و با تأیید و عنایات خداوند قادر کریم و توجه حضرت خاتم الاوصیاء و بقیةالله ارواحنا لمقدمه الفداء و پشتیبانی بینظیر ملت متعهد ارجمند از نظام و حکومت،قابل قبول و تحمل نیست که به اسم انقلاب و انقلابی بودن خدای نخواسته به کسی ظلم شود و کارهای خلاف مقررات الهی و اخلاق امام بزرگوا میفرمایند:«در اسلام دموکراسی مندرج است و مردم آزادند در اسلام،هم در میان عقاید و هم در اعمال؛مادامی که توطئه در کار نباشد و مسائلی را عنوان نکنند که نسل ایران را منحرف کنند»."
