"ممکن است برای کسی این پرسش پیش بیاید که پس چرا با کثرت این همه احکام، همه مسائل به طور مفصل در قرآن نیامده است؟ در پاسخ گفته میشود: بنا نبوده که قرآن به تنهایی مبین و بیانگر قوانین خدا باشد بلکه بنا بوده که در کنار سنت و عترت، قوانین برای مردم بیان شود، به عبارت دیگر، میتوان گفت قرآن یک قانون اساسی است که اصول و کلیات احکام در آن آمده است، ولی فروع و گستردگیهایش را باید از زبان پیغمبر و عترت بشنویم.
دین اسلام آدمکشی ندارد و اینکه بعضیها میگویند این قانون، خشن است، آیا میتوانند جامعهای بسازند که هرکس، هر فردی را خواست بکشد و آزاد باشد، یعنی فرد قاتل هیچگونه احساس هراسی نکند؟ تعداد احکام حقوقی مربوط به امور جزایی یا تعداد جرائم و مجازاتهایی که در قرآن مطرح شده، بسیار محدود میباشند در حالی که مسائل حقوقی در سنت و روایات، بسیار گسترده و فراوانند، این مسأله چگونه قابل تعبیر و توجیه باشد؟ در پاسخ به پرسش اول هم عرض کردم بنا است که فروع و شاخ و برگهای دین را سنت بیان کند."
