خلاصة:
ازجمله قواعد پرکاربرد در قلمرو فقه و حقوق «قاعده تحذیر یا هشدار» است که بهموجب این قاعده هر شخص قبل و بعد از اقدام به عملیات خطرناک و مهلک باید به سایرین هشدار دهد که در صورت وجود شرایط لازم از مسیولیت مدنی و کیفری معاف و در غیر آن، دارای مسیولیت مدنی و کیفری خواهد بود (قد اعذر من حذر). قاعده هشدار دارای پشتوانه فقهی نیز میباشد که منابع آن عبارتاند از کتاب، سنت، شهرت و بنای عقلاء و عرف که میتوان مهمترین آن را بنای عقلا برشمرد. در میان مبانی مطروحه در رافعیت ضمان از عامل زیان میتوان قطع رابطه استناد عرفی را مبنای عدم مسیولیت هشداردهنده (عامل زیان) برشمرد. تناسب هشدار با خطر، قانونی و روا بودن فعل هشداردهنده، تقدم هشدار بر ضرر، امکان درک و ترک خطر، شرایط قاعده هشدار را تشکیل میدهند؛ افزون بر شروط یادشده، هشدار نباید به گونهای باشد که موجب تحدید فضای عمومی جامعه و مخالف اصل ۴۰ قانون اساسی باشد. لذا در این پژوهش به قاعده هشدار بهعنوان شرایطی که میتواند ادله اثبات مسیولیت حقوقی اشخاص را اثبات نماید پرداخته و حول آن، قوانین داخلی و بینالمللی مرتبط را به شیوه توصیفیتحلیلی بررسی نمودهایم و نویسندگان معتقدند قاعده هشدار ریشه در مبانی عرفی دارد و میتواند مبنای اثباتی مسئولیت مدنی قرار بگیرد.
