سیاست جنایی، بهمعنای مجموعه استراتژیها و تدابیری که در یک جامعه در قبال جرم و انحراف اتخاذ میشود، به شدت با نگرشهای بنیادین حاکم بر اندیشه واضعان خود در مقولاتی همچون، آزادی و قدرت و برابری انسانها پیوند دارد. ماهیت راهبرد نظم و امنیت اجتماعی و شیوههای آن، بر حسب میزان اهمیت این مقولهها رقم میخورد و مدلهای گوناگونی از سیاست جنایی را پدید میآورد. برخی به ناصواب، از منزلت پایین آزادی در سیاست جنایی اسلام سخن گفته و آن را توتالیتر تام معرفی کردهاند. این مقاله میکوشد جایگاه آزادی در سیاست جنایی اسلام را در پرتوی اصول بنیادینی همچون عبودیت و کمال و کرامت انسانی، با روش توصیفی ـ تحلیلی تبیین کند. نتایج حاکی از این است که هرچند در فلسفة لیبرالیسم، کمال انسان در صیانت از منافع در سطح فردی و کرامت انسانی در آزادی اوست، حتی اگر با فطرت و عقل مغایر باشد، اما در سیاست جنایی اسلام، هرگز بعد فردیت انسان در بعد اجتماعی او مضمحل نشده و عدالت، امنیت و آزادی از عناصر لازم برای نیل به کرامت انسانی و راهی برای دستیابی به کمال بوده که در سایۀ بندگی و عبودیت خداوند متعال محقق میشود.
Criminal policy, meaning the set of strategies and measures taken in a society against crime and perversion, is strongly linked to the fundamental attitudes that govern the thought of its founders in categories such as freedom, power and equality of human beings. The nature of the strategy of social order and security and its methods is shaped in terms of the importance of related categories and different models of criminal policy are created. Some have mistakenly argued for the low status of freedom in Islamic criminal policy and have introduced it as absolute totalitarian. Drawing on descriptive-analytical method, this article seeks to explain the position of freedom in Islamic criminal policy in the light of fundamental principles such as worship, perfection and human dignity. The results show that in the philosophy of liberalism, human perfection depends on the protection of interests at the individual level and human dignity depends on his freedom even if it is contrary to nature and reason. However, in Islamic criminal policy, the dimension of human individuality is never destroyed in his social dimension, and justice, security and freedom are the necessary elements to achieve human dignity. They are ways to achieve perfection through the servitude and worship of God Almighty.
