حیله در فقه یعنی رسیدن به مطلوب شرعى و هدف مشروع؛ چه اینکه راه رسیدن به آن، امری حلال باشد یا راه مذکور، خود غیر مشروع باشد و در اصطلاح حقوق ایران به معنای استعداد استفاده از سکوت یا اجمال قانون بهمنظور اکتساب حق برای غیرمحق از راههایی که مخالف با ماهیت قانون است و در اصطلاح حقوق فرانسه، به معنای عملی زیرکانه که با استفاده از عیوب مخفی و پنهانی قانون، فرد به دنبال انجام عملی بهظاهر قانونی است. این تعاریف مختلف، سبب تفاوت در مصادیق حیله و بالطبع آن راهکارهای مقابله با آن شده است. پژوهش حاضر به روش توصیفی ـ تحلیلی صورت پذیرفته و درصدد پاسخ به پرسشهایی از قبیل «حیله، مصادیق و راهکارهای مقابله با آن در فقه امامیه، حقوق ایران و فرانسه چیست؟» است.مصادیق حیله در فقه امامیه به سه دسته تقسیم میشوند: مصادیق حیلۀ واقعى مثبت و مشروع؛ مصادیق حیلۀ واقعى منفى و مذموم؛ مصادیق حیلۀ صورى. مصادیق حیله در حقوق ایران و فرانسه را میتوان به دو بخش مصادیق حیلۀ ناقض قوانین شکلی و مصادیق حیلۀ ناقض قوانین ماهوی تقسیم کرد.در فقه امامیه برای حیلههای مباح راهکار مقابله وجود ندارد، اما برای حیلههای حرام دو راهکار پیشنهاد شده است؛ راهکار اخلاقی، یعنی تقوا و راهکار فقهی، یعنی حکم به حرمت. راهکارهای مقابله با حیله در حقوق ایران عبارتاند از: نظریه انگیزه یا جهت؛ نظریه حسن نیت؛ نظریه منع سوءاستفاده از حق؛ نظریه نظم عمومی؛ قاعده تبعیت عقد از قصد؛ قاعده سد ذرایع؛ قاعده «یعامل المکلف بنقیض مقصوده» و در مورد راهکارهای مقابله با حیله در حقوق فرانسه میتوان به اجرای قوانین اتحادیه اروپا؛ ایجاد نهادهای مختلفی برای مبارزه با حیله و تقلب؛ شناسایی نقاط پوشیده از چشم قانون توسط فناوریهای دیجیتال؛ تعیین قوانین موردی و موضوعی؛ تعیین مجازات در قوانین کیفری اشاره کرد.
