خلاصة:
اعتزال و اعتراض سیاسی از گونههای مخالفت و مبارزه با نظام سیاسی مستقر است. در اوّلی، مخالف سیاسی، عزلت و گوشهگیری را اختیار نموده و با عدم مشارکت و سکوت سیاسی در صدد تضعیف نظام سیاسی حاکم بر میآید. در اعتراض سیاسی، مخالفت با اقدام و به قصد ضربهزدن به نظام سیاسی، ابراز میشود. بررسی دیدگاه فقهی فقیهان شیعه ـ بویژه محقق نایینی ـ پیرامون حکم فقهی اعتزال و اعتراض سیاسی، پرسش اصلی پژوهش پیشِرو است. این نوشتار با روش توصیفی ـ تحلیلی و ابزار گردآوری اطلاعات کتابخانهای نشان میدهد که فقیهان شیعه تا قبل از نهضت مشروطه، در مسأله اعتراض و اعتزال سیاسی، میان حاکمان عدل و جور تفکیک قائل شدهاند. اگر چه فقیهان شیعه از جنبه نظری، اعتراض و اعتزال سیاسی نسبت به حاکم جور را موجه میدانند؛ ولی سیره عملی آنان، بیشتر بر اعتزال سیاسی متمرکز بوده است. آنها در نسبت با حاکم عادل، سخنی از اعتزال سیاسی به میان نیاوردهاند؛ با این حال، اعتراض سیاسی را ناموجه دانستهاند. نایینی علاوه بر اینکه به صراحت اعتزال سیاسی را نوعی مبارزه با حکومت مستقر میداند؛ اعتراض سیاسی را نیز وارد عرصه عمل فقیهانه خویش نموده است. از برخی دیدگاههای فقهی نایینی به دست میآید که ایشان مسأله «النصیحة لائمة المسلمین» را با اعتراض سیاسی خلط کرده و در نتیجه حتی علیه حاکم عادل نیز اعتراض سیاسی را موجه دانسته است. در حالی که موضوع اعتراض سیاسی ـ به معنایی که بیان شد ـ حاکم جائر است.

In the first one, the dissident chooses isolation and seclusion and seeks to weaken the ruling political system by non-participation and political silence. In political protest, opposition is expressed by action with the intention of endamage the political system. Examining the jurisprudential point of view of Shia jurists - especially Mohaqeq Naini- regarding the jurisprudential rule of political oust and protest is the problem of the present research.This article through descriptive – analytical way and library information says that the Shia jurisprudents until the constitutional movement have made a distinction between the just rulers and cruel ones in the issue of political protest and oust. Although the Shia jurists theoretically consider political protest and oust towards cruel ruler to be justified; But their practical way has focused more on political oust. They have not mentioned political oust in relation to just rulers; At the same time, they considered the political protest unjustified. In addition to the fact that Naini clearly considers political oust as a kind of struggle against the established government; He has also included political protest in his jurisprudential thought. From some of Naini's jurisprudential opinions, it can be concluded that he confused the issue of "Advice to the Muslims" with political protest, and as a result, he considered political protest justified even against a just ruler, while the subject of political protest - in the sense that was expressed - is the cruel ruler.
