The recommended night prayer is one of the worships that has been emphasized by the verses and traditions of the innocent Imams (s.a), and an insistence on it has been practically continued by the practical biography (sirah) of the Innocents and the righteous elders of the past. One of the religious precepts that has deprived many enthusiasts of it from carrying out it, is the time of this prayer which in accordance with the well known viewpoint of the jurists, its beginning is midnight, and its end is the true down. Among the contemporary jurisprudents, except two or three personalities, the majority of them have delivered the same religious decision (fatwa) based on that famous theory. Reviewing and criticizing the evidence of the famous theory which is totally seven case, this article has proved with various evidence, circumstances and proofs that the time of the mentioned prayer is the beginning of the night, but the midnight later is the time virtue of prayer, and the more the night prayer approaches dawn and rising, the more virtue it has.

This writing, while examining and criticizing the arguments of the famous opinion, which total seven cases, proves through various evidences, clues, and supports that the time for the night prayer starts from the beginning of the night; however, from midnight onwards is the time of virtue, and the closer it gets to the dawn (Sahar) and the rising of the true dawn, the greater the virtue it possesses.
Therefore, the implication of the Muwathaqah of this narration does not conflict with the explicit meaning (mantuq) of the evidences which indicate that the time for the night prayer is the beginning of the night and midnight onwards is the time of excellence.
Sixth Narration According to the indication of a group of narrations, in the choice between whether the night voluntary prayer (nafilah) should be recited at the beginning of its time or performed as a makeup prayer (qada) after its time, performing it as qada is preferred over reciting the night prayer before midnight; for example, one can refer to the sahih narration of Muawiyah bin Wahb: Imam Sadiq7, in response to one of his lovers and righteous followers who had complained about not being able to wake up from sleep for the night prayer, said: «اجازه ندارد نماز شب را در اول شب بخواند.
