Abstract:
قاعده تدلیس به عنوان یکی از مهمترین قواعد فقهی سعی در حمایت از اشخاصی است که به هر نحوی دچار خسران و ضرر شده است. تدلیس در حوزه حقوق خانواده در موقعیت های مختلفی پیش می آید که در این تحقیق با روش تحلیلی- توصیفی به بیان این موارد پرداخته شده است. تدلیس در شخصیت یکی از زوجین از جمله مواردی است که غالبا در جامعه جریان دارد و افراد با معرفی خود به عنوان شخصیت مهم یا شخصی که شغل بسیار مهمی دارد و.... اتفاق می افتد. اظهار یا کتمان نابجا در خصوص ویژگی های جسمی همچون تصویر سازی مصنوعی و نمایش های غیرواقعی از چهره ظاهری فرد، مخفی سازی با ترمیم عیب ها و کاستی های مشهود، وضعیت سلامت و بیماری (همچون استفاده از موی مصنوعی یا رنگ مو، دندان مصنوعی، سمعک، عینک، جراحی پلاستیک با ابتلا به دیابت، ایدز، بیماری های ریوی، کلیوی، پوستی و ...)، دوشیزگی، عادت ها و شرطی شدن های غیر معمول (مثل اعتیادبه دخانیات، مواد مخدر و مشروبات الکلی) ویژگی های اخلاقی، منظور از عیب غیر منصوصه عیویی غیر از موارد ذکر شده در مواد ۱۱۲۲ و ۱۱۲۳ می باشد. به صورت کلی پنهان کردن و یا عدم ذکر خصوصیاتی که در نظرات زوجین مد نظر قرار گرفته و متباینا بر آنها توافق شده است، می تواند موجبات استناد به قاعده فقهی تدلیس را فراهم کند.
As one of the most important jurisprudential rules, the Tadlis rule is an attempt to support people who have suffered losses in any way. Tadlis in the field of family law occurs in various situations, which are discussed in this research with analytical-descriptive method. Taming the character of one of the couple is one of the things that often happens in the society and it happens when people introduce themselves as an important person or a person who has a very important job and so on. Misrepresentation or concealment of physical features such as artificial depiction and unrealistic representations of a person's appearance, concealment by repairing obvious flaws and shortcomings, health and illness status (such as using artificial hair or hair color, artificial teeth, hearing aids, glasses, plastic surgery with diabetes, AIDS, lung, kidney, skin diseases, etc.), virginity, unusual habits and conditioning (such as addiction to tobacco, drugs and alcohol) moral characteristics Non-documented defect means defects other than those mentioned in articles 1122 and 1123. In general, hiding or not mentioning the features that are considered in the opinions of the couple and mutually agreed upon, can provide grounds for invoking the jurisprudential rule of Tadlis.
