Abstract:
زمینه و هدف: حقوق بشر در محیط کار شامل موارد زیادی از حق اشتغال تا حمایت اجتماعی است. در اعلامیه حقوق بشر و سایر اسناد حقوق بشری بر حق انتخاب شغل، عدم تبعیض و حق برخورداری از شرایط منصفانه و انسانی تاکید شده است. در مقاله حاضر به نقش کار شایسته در رعایت موازین حقوق بشری کارگران با رویکردی به آموزههای فقهی پرداخته میشود. مواد و روشها: مقاله توصیفی - تحلیلی بوده و از روش کتابخانهای استفاده شده است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است. یافتهها: یافتهها بر این امر دلالت دارد که کار شایسته در رعایت موازین حقوق بشری کارگران تاثیرگذار است. اشتغال، منع کار اجباری، دستمزد عادلانه، حق داشتن تشکل صنفی و حمایت اجتماعی از سازوکارهای تاثیر کار شایسته بر تحقق موازین حقوق بشری کارگران است. در فقه نیز به مولفههای حقوق بشری کارگران درخصوص حمایت اجتماعی، دستمزد عادلانه و عدم کار اجباری تاکید شده است. نتیجهگیری: تاثیرگذاری کار شایسته لزوما همیشه مثبت نیست. گاهی بایستهها و استاندارهای مورد تاکید کار شایسته سبب نقض موازین حقوق بشری کارگران میشود. این امر که در کشورهای در حال توسعه روی میدهد در مواردی به دلیل تعیین حداقل سن کار، سبب اخراج کودکان کار از کارخانهها و سوق دادن آنها به شغلهای کاذب میشود.
Background and Aim: Human rights in the workplace many issues from the right to employment to social protection includes. The Universal Declaration of Human Rights and other human rights instruments the right to choose one's job, non-discrimination, and the right to a just and humane environment emphasizes. In the present article, the role of decent work in observing the human rights standards of workers with an approach to jurisprudential teachings is discussed. Materials and Methods: This article is Analytical descriptive and uses the library method. Findings: The findings indicate that decent work in respecting the human rights standards of workers is effective. Employment, prohibition of forced labor, fair wages, the right to form a trade union and social protection are among the mechanisms for the effect of decent work on the realization of the human rights standards of workers. Also In Jurisprudence the human rights components of workers regarding social protection, fair wages, and non-forced labor Is emphasizesed. Conclusion: The effectiveness of decent work always is not necessarily positive. Sometimes the requirements and standards emphasized for decent work workers' human rights standards violates. In developing countries, this leads to the expulsion of working children from factories and their forced employment.
