Abstract:
در دادرسی مدنی صدور حکم غیابی امری استثنایی است و از اینرو، بدیهی است که برخی قواعد خاص و ویژه بر فرایند رسیدگی به دعوا حاکم باشد. بهدلیل غیبت خوانده، دخالت دادرس در دعوای باید بیشتر و جدیتر باشد. برخی ایرادات احتمالی نیز باید به صورت سرخود مورد توجه قرار گیرد. به منظور تأمین سرعت در دادرسیها، قانون آیین دادرسی مدنی حل و فصل برخی از موضوعات مانند صلاحیت یا ایرادات آیین دادرسی را در زودترین موعد مقرر داشته است. با اینحال، در دادنامه موضوع تحقیق حاضر، پاسخ به یکی از نخستین پرسشهای دادرسی یعنی مساله صلاحیت دادگاه بیش از یکسال زمان برده و سرانجام، با دو بار رسیدگی در مرجعی غیرصالح، با ورود دیوانعالی کشور بهدادگاه صالح ارجاع شده است. بیگمان، چنین ترتیبی موجب تحمیل هزینه به نظام دادرسی به عنوان نماینده حقوقعمومی و دادخواهان این پرونده و سایر مراجعان میشود و روشناست که رفعمشکل آن را باید بسیار زودتر از آنچه کهدیدم، تدبیر شود. با سپردن برخی اختیارات به دادرس میتوان مدیریت بهتری را بر موضوع اعمال کرد و از تکرار چنین وضعیتی پیشگیری شود. با این حال، دادنامه صادر شده از دیوانعالی کشور با توجه بهمقررات فعلی، رعایتحق خصوصی خوانده را مقدم دانسته و بانقض حکمغیابی، پرونده را به مرجع صالح ارسال داشته است که باتوجه به قانون آییندادرسی تصمیم صحیحی بهنظر میرسد.
In civil proceedings, rendering a default judgment is exceptional, and it is therefore obvious that some special rules must govern the judicial process. Due to the absence of the defendant, the intervention of the judge in the case should be more substantial and consequential. Some possible objections should also be directly taken into consideration by the sitting judge. In order to speed up proceedings, the Civil Procedure Act has set forth the resolution of certain issues, such as jurisdiction or objections concerning procedure as soon as possible. However, in the judgment discussed in the present article, the answer to one of the first questions related to proceedings, i.e., the issue of the jurisdiction of the court, took more than a year, and finally, after two hearings in courts that lacked jurisdiction, through the intervention of the Supreme Court it was remanded to a court that had jurisdiction. Undoubtedly, such an arrangement imposes costs on the judicial system as the representative of public rights and the plaintiffs in the case and other clients, and it is clear that the problem should be resolved much sooner than it was. By granting certain powers to the judge, the issue can be managed more expeditiously and repetition of a similar situation can be prevented. However, according to current regulations, the judgment rendered by the Supreme Court has prioritized observation of the defendant's individual rights, and while reversing the default judgment has remanded the case to a competent court, which decision seems to be correct and in accordance with the Civil Procedure Act.

ذ. نسبت به دادنامه مورخ ٩١/٦/٣٠ قرار عدم صلاحيت به شايستگي دادگستري بابل صادر کرده و اين در حالي است که اصل دادنامه مربوط به دادگاه مذکور بوده و قهرا هر نوع اعتراض و واخواهي مربوط به همان دادگاه يا تجديدنظر محل همان دادگاه است لذا دادگاه خود را صالح به رسيدگي ندانسته و در اجراي تبصره ماده ٢٧ قانون آيين دادرسي مدني پرونده را جهت حل اختلاف به ديوان عالي کشور ارسال و پس از وصول به شعبه ٨ ديوان عالي کشور ارجاع شده است .
بر رأي شعبه ٨ ديوان عالي کشور، از جهت شکلي و بيان مقدمات موضوع و استناد و استدلال اشکالي وارد نيست زيرا مطابق بند نخست از ماده ٣٧١ قانون آيين دادرسي مدني ، عدم رعايت صلاحيت محلي از موارد نقض شمرده مي شود در صورتي که خوانده نسبت به آن ايراد کرده باشد که در فرض حاضر چنين است .
