چکیده:
در خصوص نظام حقوقی حاکم بر قراردادهای بین المللی نفت دو نظر وجود دارد. گروهی آن را تابع حقوق بین الملل یا نظامات حقوقی غیر ملی می دانند و گروه دیگر آن را تابع نظام حقوقی دولت میزبان می دانند. گروه اخیر معتقدند این قراردادها از جمله قراردادهای اداری است که دولت اختیارات گسترده ای در تغییر مفاد آنها در جهت نفع عمومی دارد. به هر رو به نظر می رسد در عمل هر دو،گروه به اختیار دولت در تغییر مفاد قراردادها تن در داده اند. نکته ای که در این مقام عده ای را به محدود کردن این حق دولت متقاعد ساخته ، توافق طرفین قرارداد به محدودیت دولت در اعمال قوه حاکمیت برای تغییر در مفاد قرارداد یا شرط ثبات است که گروهی معتقدند این شرط معتبر و محدود کننده اختیار دولت است و عده دیگر معتقد به بی اعتباری آن هستند. اما به نظر می رسد تمامی دولت ها در عمل به حق خود در تغییر مفاد قرارداد عمل می کنند و هیچ توافقی نمی تواند محدود کننده حق حاکمیت ملت ها بر منابع طبیعی آنها باشد.
There are two views for determining the applicable law in international oil contracts. The first is that these contracts are governed by international law or Lex Mercatoria and by the second that they are governed by national law of host countries. In the second view it is believed that the principles of administrative law should be applicable in such contracts by which the state has certain special powers to modify the nature of the work or the performance of the contract in favour of general benefit of community. Anyway it seems that both have accepted the right of state in such modifications but it is argued if it is acceptable to restrict such right by stabilization clause. The practice experience has proved that all the states have utilized such right and it is completely legal and legitimate and no agreement is eligible to restrict the right of nations to have permanent sovereignty over their natural resources.
