چکیده:
امروزه و با تحولات دنیای جدید، پاره ای احکام فقهی در دوران معاصر (یا در برخی نقاط جغرافیایی) - نه به این دلیل که موضوع آنها منتفی شده، بلکه به سبب پیامدهای نامطلوبی که اجرای آنها به دنبال دارد - قابل اجرا نیستند. از این مسئله گاه به «بحران فقه» یاد می شود. از جمله راه کارهای پیشنهادی برای حل این - به ظاهر - بحران، بازسازی عقلانیت فقهی بر اساس عقلانیت مدرن است. این راه حل به سبب تعهدات شناخت شناسانه سنگین، تجدید نظر در مسلمات اصولی و استفاده ناروا از برخی قواعد کلامی، چندان جذابیتی برای سنت گرایان ندارد. ضمن این که به جای حل مشکل، آن را تنها یک گام به پس می راند. این راه حل با اصل مشکل در یک نقطه اشتراک دارد: رویکرد اتمیستی در استنباط احکام شرعی.
Among the solutions proposed for the current crisis in Islamic traditional Jurisprudence (Feqh) stands out the suggestion to reconstruct jurisprudential rationality on the basis modern rationality. This solution involves too heavy epistemological commitments، a revisionist approach to some of the received theorems in the science of Osul and misuse of some the theological principles accepted almost unanimously by Muslims. Therefore it fails to attract the attention of traditionalists. It fails also because it merely shifts the kernel of the problem rather than solve it. This solution shares the traditional approach it criticizes in one principal failure that is responsible for the crisis; failing to adopt a contextualized approach to jurisprudence rather than the atomistic.
