چکیده:
متعاقب تاسیس دیوان کیفری بین المللی در سال ١٩٩٨، ایالات متحده با این مسئله مواجه شد که با این نهاد تازه تاسیس چگونه و به چه نحوی برخورد کند؛ زیرا بیم ها و امیدهای بسیاری در مورد دیوان در میان سیاست مداران و تصمیم گیران آمریکایی ایجادشده بود. بدین جهت است که موضع گیریهای آمریکا در طول این سالیان ، دچار فراز و نشیب های بسیاری شده است . این سیاست ها در طیفی از همگرایی و مشارکت ، تقابل و اقدامات خصمانه و تعامل با دیوان قرار گرفته است . البته تمامی این مسائل را میتوان در چارچوب سیاست خارجی و منافع امنیت ملی ایالات متحده آمریکا تحلیل و بررسی کرد. این مقاله درصدد است ضمن بررسی سیر تاریخی این مسائل ، ایرادات حقوقی ارائه شده توسط آمریکا در مورد دیوان و اساسنامه رم را مورد مداقه قرار دهد. همچنین اقدامات حقوق بین المللی و سیاست خارجی آن کشور را بررسی خواهیم کرد تا به تحلیل چرایی اقدامات آمریکا پیرامون دیوان کیفری بین الملل دست یابیم .
