چکیده:
به رغم پیدایش قواعد نوشته و عرفی متعدد حقوق بشری، جامعه ی بشری کماکان شاهد تضعیف این حقوق به دست دولتمردان در زیر چتر توجیهات حقوقی و به ظاهر مشروع می باشد که محاکم و دیوان های بین المللی نیز همواره از این نقیصه متاثر گشته اند. از بارزترین عواملی که همیشه و در همه جا منجر به دگرگونی اجتماعی افراد اعم از تحولات خوب و بد شده است، رویکردهای اعتقادی آنان بوده که بیت الغزل آن، «نگرش های دینی» می باشد. نگرشهای دینی به رغم اینکه حداقل در ادیان ابراهیمی در اصل واحد هستند، اما بالطبع در فروعات و عمل از هم قدری دوراند که این تفاوت آنان را به سمت و سویی سوق دهد که ضوابط سیطره ی حکمرانان بر حکمبران نیز وامدار آن نگرش ها شده و جنبه ی اعتقادی و تبعیض آمیز به خود می گیرد. اجتناب از این نقیصه میسر نخواهد شد مگر به یمن تبادل افکار و عقاید میان دینداران و ادیان بزرگ. این تبادل اندیشه ها، به سه نتیجه ختم می شود: وحدت نسبی و احترام متقابل و آگاهی کامل تر (در رابطه با حق ها). این مقاله، با کاوشی در رویه های عملی دولت ها، مدارک موجود و سوابق قضایی محاکم بین المللی، ضمن بررسی نواقصی که در رویه ی بین المللی مشاهده کرده و ریشه ی آنان را دور بودن ادیان از یکدیگر می داند، سعی در ارائه ی طرحی جامع دارد که بنا بر یافته های آن، یکی از راه های تحقق احترام و رعایت جهانی حقوق بشر که در بستر اسناد بین المللی نتوانسته است به نحو اکمل عینیت یابد، گفتگوی میان ادیان الهی و استفاده از اندیشه های متقابل آنان است.
Despite the appearance of numerous written and customary human rights rules,
the human society still suffers from the ineffciency of these rules, caused by
governments, under the legal and apparently legitimate justifcations. Interna-
tional courts and tribunals have always been affected by this defciency.One can
fnd the grounds for such disruptive behavior, most of which are rooted in so-
cial backgrounds, and beyond the scope of this article. However, ideological ap-
proaches has been the one of most signifcant factors that always and everywhere
has led to public social change, the most prominent of which being "Religious
Beliefs". This factor can, through affecting the behavioral ways and norms of
the individuals, lead them (as both subjects and objects of the rules) to ways that
rulers domination Criteria on subjects are also affected by those teachings and
views that religion has brought for them. It will not be possible except through
dialogue and exchange of ideas among great religions and believers to them.
That exchange of ideas leads to three results: relative unity, mutual respect and
more complete awareness (about all the rights). This article, by conducting a re-
search in states practices, available documents and international courts case law,
and by studying the defects in international practice which are rooted in religions
being away from each other, intends to provide a comprehensive plan that based
on its fndings suggests, one of the ways to reach the universal observance and
respecting the human rights, not fully realized in the context of international in-
struments, would be the interreligious dialogue and mutual use of their thoughts.
