چکیده:
کودکان*** آیینه تمامنمای اشخاص بیدفاع در مخاصمات مسلحانه هستند، که مورد توجه ویژه دولتها قرار گرفتهاند. جامعه جهانی در حمایت از حقوق کودکان در مخاصمات مسلحانه اقدامات شایان توجهی در عرصه بینالمللی و منطقهای انجام داده است. از جمله اقدامات بینالمللی میتوان به اعلامیه حقوق کودک 1959، کنوانسیون حقوق کودک 1989، کنوانسیون چهارم از کنوانسیونهای چهارگانه ژنو و پروتکلهای الحاقی آن، و پروتکل اختیاری کنوانسیون حقوق کودک 1989، مصوب 2000 اشاره کرد. همچنین در مورد اقدامات منطقهای، میتوان به منشور آفریقایی حقوق و رفاه کودک 1990، منشور اجتماعی اروپا 1996، کنوانسیون اتحادیه آفریقا برای حمایت و کمک به آوارگان داخلی در آفریقا 2009، و کنوانسیون آمریکایی حقوق بشر 1969 اشاره کرد. این اقدامات نشانگر توجه دولتها به آسیبپذیری کودکان در مخاصمات مسلحانه است، که البته هنوز تعدادی از دولتها، به خصوص دولتهای آفریقایی نسبت به تعهدات بینالمللی خود در این زمینه بیتوجه هستند. هدف از نوشته حاضر تأکید مجدد بر حقوق کودکان با بررسی اسناد بینالمللی و منطقهای است. با توجه به تعداد بالای اسناد حمایتکننده از حقوق کودکان در مخاصمات مسلحانه میتوان نتیجه گرفت که حقوق کودک در این حوزه پذیرش عام یافته و وارد عرصه حقوق بینالملل عرفی شده است. *** منظور از کودک در این مقاله به استناد اکثر اسناد حقوق بشری و بشردوستانه شخصی است که به سن 18 سالگی نرسیده است.
Children are the true symbols of defenselessness in armed conflicts, to whom States have paid specific attention. International society has taken remarkable measures to protect the rights of children in armed conflicts, both on international and regional scales. Some of the related international instruments are: Declaration of the Rights of the Children (1959), Convention on the Rights of Children (1989), Geneva Convention IV Relative to the Protection of Civilian Persons in Time of War (1949), 1977 Protocols I and II additional to the Geneva Conventions of 1949, and the Additional Protocol to the Convention on the Rights of Children, adopted in 2000. There are also regional instruments, including African Charter on the Rights and Welfare of the Child (1990), European Social Charter (1996), African Union Convention for the Protection and Assistance of Internally Displaced Persons in Africa (2009), and American Convention on Human Rights (1969). The measures taken reveal the serious vulnerability of children in armed conflicts. A few States, especially African States, still do not honor their obligations to protect children. This article tries to stress the importance of the rights of children by investigating related international and regional instruments. Regarding the numerous instruments protective of the rights of children in armed conflicts, it can be concluded that the rights of children with respect to armed conflicts have been accepted worldwide, and therefore have entered into international customary law.

در بخش اسناد منطقه اي، بعد از بيان توضيحي مختصر از مجموع پيشرفت هـاي حاصــله در منــاطق و قــاره هــاي مختلــف جهــان و ارائــه فهرســتي از اســناد معاهــده اي و غيرمعاهده اي حامي کودکان در مخاصمات مسلحانه ـ هم در حوزه حقوق بـين الملـل بشـر و هم در حوزه حقوق بين الملل بشردوستانه ـ دربـاره منشـور آفريقـايي حقـوق و رفـاه کـودک ١٩٩٠، کنوانسيون اتحاديه آفريقا براي حمايت و کمک به آوارگـان داخلـي در آفريقـا ٢٠٠٩، منشور اجتماعي اروپا ١٩٩٦، و کنوانسيون آمريکايي حقوق بشر ١٩٦٩ بحث خواهيم کرد.
