چکیده:
علیرغم تلاشی که فقها و حقوقدانان برای تبیین رابطهی آدمی با اعضای بدن خود و «نحوهی سلطهی» وی بر آنها داشته اند و ثمرهی عملی این تلاش، گاه نمادی بیرونی یافته است و آن نحوهی سلطه، «اهدای عضو» را جایز میشمارد هنوز جای کنکاش و پرسش باقی است؛ پرسشی نه تنها در ثمرات عملی و بیرونی آن مبانی نظری؛ بلکه باز هم در خود مبانی نظری رابطهی آدمی با اعضای پیکر خود. دامنهی این پرسش، ممکن است تا آنجا گسترش یابد که آیا شخصی میتواند دیگری را بر کشتن خویش اکراه کند و او را تهدید نماید که «اگر مرا نکُشی، تو را میکُشم» و نتیجهی این سخن، آن باشد که چون شخص مکرِه بر بدن خود سلطه داشته و اکراه وی، رضایت ضمنی او بر رفع مسؤلیت مکرَه محسوب میشود پس مکرَه از هر نوع مسؤولیتی تبرئه گردد؟ با نگاهی به مبانی نظری و استدلالات فقها و حقوقدانان، حتّی با وجود تحقّق عناصر اکراه در موضوع مورد بحث، شخص مکرَه از مسؤلیّت کیفری با این عنوان مبرّا نخواهد بود.
Despite the efforts of jurists and lawyers to explain the relationship between man and his "mode of domination" to his own members, there remain ambiguities about the theoretical foundations of human relations with members of his body.
