چکیده:
حقوق بینالملل برخی قواعد از جمله منع شکنجه و نسلکشی را به عنوان قاعده آمره بینالمللی شناسایی کرده و هر توافق معارض با آن را باطل و بیاثر شمرده و هر فعل مغایر با این قواعد را جنایت قلمداد کرده است. با این حال، حقوق بینالملل کماکان مبتنی بر منافع و اراده دولتهاست. از این رو، جامعه بینالمللی نهتنها از تعیین مصادیق بلکه که از تعریف بیابهام و دقیق قواعد آمره نیز باز مانده است. مسلم است که هنوز یک سلسله اوامر و نواهی بینالمللی وجود دارند که گرچه به عنوان یک قاعده آمره بینالمللی اعلام نشدهاند ولی اوصاف و ویژگیهای قاعده آمره بینالمللی را دارند و با معیارهای آن نیز منطبق هستند که یکی از آنها ممنوعیت استفاده از سلاحهای شیمیایی است. وجه مشترک قاعده منع استفاده از سلاحهای شیمیایی با قواعدی از قبیل منع شکنجه در این است که تمامی آنها اعمال شنیعی را منع کردهاند که وجدان انسانی تحمل رخ دادن آنها را ندارد. بر این اساس، مقاله حاضر به دنبال پاسخ به این پرسش است که آیا میتوان مدعی اعتلای قاعده منع استفاده از سلاحهای شیمیایی به مرتبه قاعده آمره شد؟ در حال حاضر گرچه قاعده منع استفاده از سلاحهای شیمیایی به صراحت به عنوان قاعده آمره شناسایی نشده است ولی منطبق بر معیارها و همچنین و ویژگیها قاعده آمره بینالمللی به نحو مندرج در کمسیون حقوق بینالملل درسال ۲۰۱۷ است.
Certain norms of international law which are peremptory in nature such as prohibition of torture and genocide has been recognized as jus cognes by international society and any conflicting rule is declared as void. However, international law has its root in State wills as always. Thus, international society has not managed to enumerate examples of its peremptory rules but also to define its concept without any ambiguity. It is evident that there are some rules such as prohibition of use of chemical weapons which are not declared as peremptory rules but their general nature resample to peremptory rules and meet the criterion of peremptory rules of international law. Common feature of rule the rule prohibiting use of chemical weapons with the rules such as prohibition of torture is that all of these kind of rules prohibit heinous acts which cannot be tolerated by Conscience of any human being. This article seeks to answer the question that whether the rule of prohibition of use of chemical weapons is a peremptory rule. Although, the rule has not expressly been declared as a peremptory rule, but it is in conformity with the criterion and elements of general nature of the rule as embodied in the report of international law commission in 2017.

بر اساس اين ماده و همچنين مادة چهار گزارش دوم ، دو معيار براي تشخيص يک هنجار به عنـوان قاعدة آمره بين المللي وجود دارد: نخست اينکه هنجار مورد ارزيابي در زمرة قواعد حقوق بـين الملـل عـام 8 باشد و دوم ، به عنوان قاعده اي پذيرفته و شناخته شده باشد که تراضي برخلاف آن مجاز نيست .
