چکیده:
مرگ و فرار مرتکب جنایت عمدی، ازجمله عوامل تعذر استیفای حق قصاص است. فقیهان در موارد گوناگون تعذر قصاص به استناد روایات خاص یا قواعد و اصول حاکم بر این مسئله، فتاوای مختلفی درباره ضمان به دیه برعهده مرتکب، الاقرب فالاقرب از ورثه، عاقله یا بیتالمال دادهاند. قانون مجازات اسلامی نیز در ماده 435 مقررات مربوط به این موضوع را براساس آرای برخی فقیهان ذکر کرده است. در این نوشتار بعد از نقد و بررسی مفاد این ماده و فتاوا و ادله فقیهان، در برخی مسائل یکی از اقوال رجحان داده شده و در برخی دیگر از مسائل، قول جدیدی تأسیس گردیده است. درنهایت پیشنهادهایی برای اصلاح قانون ارائه شده است.
Death and escape of the person who has committed intentional crime are among the factors that make the right to qisas[1] impossible. In various cases of the impossibility of qisas, based on specific narratives or the rules and principles governing this issue, foqaha have given different fatwas regarding the indemnification for diya[2] by the perpetrator, al-’aqrab -fel-’aqrab[3] of the heirs, aqeleh[4] or bayt al-mal[5]. Likewise, the IPC in Article 435 has referred to the provisions of the issue, i.e., the impossibility of the execution of retaliation, according to the opinions of some foqaha. In this paper, after reviewing the provisions of this article, the fatwas of foqaha and their arguments, in some cases one of the arguments (reasoning-based ideas) has been given priority and in some other matters a new argument has been established. Finally, some suggestions for amending the law are presented.
[1] An Islamic term meaning "retaliation in kind", "eye for an eye", or retributive justice. In traditional Islamic law (sharia), the doctrine of qisas provides for a punishment analogous to the crime. Qisas is available to the victim or victim's heirs against a convicted perpetrator of murder or intentional bodily injury. In the case of murder, qisas gives the right to take the life of the killer, if the latter is convicted and the court approves. Those who are entitled to qisas have the option of receiving monetary compensation (diyya) or granting pardon to the perpetrator instead.  
[2] In Islamic law, diya is the financial compensation paid to the victim or heirs of a victim in the cases of murder, bodily harm or property damage. It is an alternative punishment to qisas (equal retaliation). In Arabic, the word means both blood money and ransom, and it is spelled sometimes as diyah or diyeh.
[3] Nearest and then the nearer of kin; a principle upon which whenever it is supposed that a diya be executed for a convicted person and for some specific reasons, it is not possible to receive a diya from that convicted person, those who are closest to him in kinship should prepare the diya in order of closeness.
[4] Aqeleh refers to those who have close kinship from father side to a convicted perpetrator (i.e., brothers, paternal uncles, and their children).

خلاصه ماشینی:
برایناساس بر ماده 435 ـ برخلاف ماده 260 قانون گذشته ـ اشکال وارد است؛ زیرا در این ماده در مورد هر دو فرض فرار و مرگ مرتکب آمده است: «دیه جنایت از اموال مرتکب پرداخت میشود و درصورتیکه مرتکب مالی نداشته باشد، درخصوص قتل عمد، ولیدم میتواند دیه را از عاقله بگیرد و در صورت نبود عاقله یا عدم دسترسی به آنها یا عدم تمکن آنها، دیه از بیتالمال پرداخت میشود».
این اشکال بر ماده 260 قانون گذشته وارد نیست؛ زیرا اگرچه در ماده 260 هم از عبارت «چنانچه مالي نداشته باشد» استفاده شده، اما ماده 260 فقط به فرضی مربوط است که مرتکب پس از فرار مرده است و چنانکه گذشت، در چنین فرضی دیه از همة اموال مرتکب ـ خواه از مستثیات دین باشد یا از غیر آن ـ پرداخت میگردد و درصورتیکه هیچ مالی برای مرتکب نباشد، دیه از عاقله پرداخت میشود.
1. 2 قول دوم: سقوط دیه به نظر ابنادریس و برخی دیگر از فقها در همة چهار فرضی که قصاص به علت فرار، مرگ یا هر علت دیگری ممکن نیست، دیه از مال قاتل یا عاقله ساقط است؛ زیرا جنایت عمد، فقط موجب قصاص است ـ نه تخییر بر قصاص و دیه ـ و برای تبدیل قصاص به دیه باید دلیل معتبری اقامه شود و دلیلی وجود ندارد؛ زیرا روایات مطرحشده اخبار آحاد هستند که معتبر نمیباشند (ابن ادریس، 1410ق: ج3، ص330؛ آبی، 1417ق: ج2، ص622).
