چکیده:
همانطور که هگل در پیشگفتار کتاب مبانی فلسفه حق بیان کردهاست؛ بحث مرکزی در این اثر، از بین بردن خودسرانگی اراده است که همان معنای عامیانه آزادی است. هگل در صدد ردیابی تحقق مفهوم آزادی به عنوان ایده در نفسالامر است. نگارنده معتقد است که در هر دو گذار هگل میان سه بخش اصلی این اثر یعنی از حق انتزاعی به اخلاق و از اخلاق به حیات اخلاقی، او خودسرانگی اراده را به عنوان نمود فاقد مفهوم رفع کرده است. در گذار نخست شخص به عنوان تعین حق انتزاعی که آزادی خویش را تنها در تملک چیزهای خارجی و بازشناسی آن از طریق دیگری مییابد، در دیالکتیک ناحق و رفع آن اسیر ارادهی خودسرانهی فرد جزئیای میشود که جرم را وارد تسلسلی نامتناهی میکند. بنابراین بازشناسی ساحت کلی درون انسان در جهت قانونگذاری امر خیر در مقام اخلاق ضرورت پیدا میکند. در این بخش وجدان به عنوان متعین کننده خیر درونی انسان، پس از آنکه تمامی نهادها و قوانین عرف را در درون خویش مستحیل میسازد، به دلیل صوری بودن قانونش، به جای ارادهی امر کلی، ارادهی جزئی خویش را به عنوان محتوای قانون مطلق، وضع میکند و از این طریق ادعای مطلق بودن میکند که هگل آن را نتیجه اخلاق کانت و اینهمان با منطق حکومت ترور در فرانسه میداند. هگل در جهت رفع این خودسرانگی، به وجه ممیزه فلسفه اخلاق خویش یعنی حیات اخلاقی گذار میکند که در آن محتوای قانونهای اخلاقی بایستی از طریق نهادهای جهان اجتماعی بالفعل که شخص در آن ساکن است چارچوببندی شوند.
