چکیده:
مقدمه: با پیشرفت علوم پزشکی، دنیای حقوق نیز دچار تحول میشود، زیرا هر کدام از دستاوردهای پزشکی، مسایل خاص خود را پدید میآورند که در چنین مواردی نیز قانون باید برای حل مشکلات جدید ایجادشده، راه حلهای قانونی تعیین کند. لذا همگامساختن علم حقوق با علوم پزشکی امری ضروری و اجتنابناپذیر است. حقوق شبهجرم بهعنوان یکی از راهکارهای قانونی برای مقابله با مسامحه و قصور پزشکی نسبت به بیماران ارایه شده است که تا حد امکان، به تامین حقوق بیماران پرداخته است. هدف این پژوهش، بررسی جایگاه مسامحه پزشکی در پرتو حقوق شبهجرم بود.
نتیجهگیری: برای آن که بتوان پزشک را بهدلیل ارتکاب مسامحه مسئول دانست، ضروری است که سه عنصر به اثبات برسد؛ اول این که پزشک باید وظیفه قانونی مراقبت نسبت به بیمار داشته باشد. دوم آن که نقض وظیفه قانونی مراقبت توسط پزشک صورت گیرد و آخرین عنصر، وجود رابطه سببیت بین نقض وظیفه مذکور توسط پزشک و ورود آسیب به بیمار است. نکته حائز اهمیت در ارتباط با عناصر مذکور این است که بیمار باید هر سه عنصر را به اثبات برساند، در غیر این صورت، مسئولیتی متوجه پزشک نخواهد بود. بنابراین اگر پزشک منطبق با اصول پزشکی و با مهارت لازم روند درمانی بیمار را انجام داده باشد و بیمار نتواند مسامحه وی را به اثبات برساند، مسئول آسیب وارده نخواهد بود و چه بسا ممکن است آسیب وارده بر بیمار در نتیجه تقصیر و مسامحه خود بیمار باشد که در حقوق شبهجرم تحت عنوان مسامحه مشارکتی مورد اشاره قرار گرفته است.
Introduction: With the advances in medical science, the world of law has also evolved. Because each medical achievement creates its issues, in which the law must also provide legal solutions to the newly created problems. Therefore, integrating the science of law with the medical sciences is necessary and inevitable. Tort law, as one of the legal strategy for dealing with medical negligence and malpractice, provided the rights for patients. The aim of the present study was to investigate the position of medical negligence in the light of tort rights.
Conclusion: In order to recognize a physician as responsible for medical negligence, it is necessary to prove three elements. First, a physician must have a legal obligation to patient care. Secondly, a physician must violate the legal obligation of care of the patient and the last element is the causal relationship between the violation of an obligation by a physician and the injury to the patient. The important matter about these elements is that the patient has to prove all three elements, otherwise, the physician will not be responsible for the negligence. Therefore, if the physician has performed the patientchr('39')s treatment process in accordance with the medical principles and required skills and the patient is unable to prove the negligence of the physician, then the physician will not be responsible for the negligence and harm to the patient may be due to the patientchr('39')s fault and negligence. It is known as collaborative negligence in tort law.
