چکیده:
هدف پژوهش حاضر بررسی فقهی حقوقی اذن و برائت درجرایم ناشی از عملیات پزشکی در فقه امامیه و حنفی میباشد. روش تحقیق موردنظر کیفی میباشد. در گستره جرایم و تخلفات پزشکی بهمنزله مقولهای از حقوق پزشکی، از یکسو، اعمال و ترک اعمالی که مشمول جرم میشوند دامنه جرم و تخلفات پزشکی، مبانی و شرایط تحقق آنها مشخص و موردمطالعه قرارگرفته و از سوی دیگر عواقب و شدت جزای ناشی از آنها نیز موردتوجه قانونگذار قرار میگیرد. در قانون مجازات اسلامی و مدنی تصریحشده باوجود صحت این مطلب که پزشک سوءنیتی در انجام فعالیتش ندارد، اما قانونگذار پزشک را ضامن محسوب کرده است. قانونگذار در مواردی که قصور، تخلف و سهلانگاری و عدم رعایت نظامات دولتی یا غیره از طرف پزشک موجب فوت بیمار شود، مجازات 6 تا 2 سال حبس را پیشبینی کرده است. قانونگذار در مباحث پزشکی عنوان تخلفات را بهکاربرده است و از لفظ جرم استفاده نکرده است. در جوامعی که خواهان اجرای قانون هستند، دستگاه عدلیه آخرین راهحل است. درحالیکه در ایران به آن بهعنوان اولین راهحل برای رفع مشکلات و معضلات نگاه میشود. پزشک در انجام تمامی اقدامات پزشکی اعم از معالجات درمانی و اعمال جراحی در درجه اول باید رضایت بیمار یا اولیا یا سرپرستان یا نمایندگان قانونی وی را اخذ کند (در موارد فوری اخذ رضایت ضروری نیست) و در مرتبه بعدی رعایت موازین فنی و علمی و نظامات دولتی ضروری است. محقق بر اساس پژوهش انجامشده به این نتیجه دستیافت که: اذن و برائت درجرایم ناشی از عملیات پزشکی در فقه امامیه و حنفی از منظر فقهی حقوقی متفاوت است.
he purpose of the present study is to investigate the legal jurisprudence of permissible and permissible offenses arising from medical operations in Imamieh and Hanafi jurisprudence. The research method is qualitative. In fact, the lawmaker has used the title of offenses in medical matters and has not used the term crime. In societies that want to enforce law, the justice system is the last resort. While in Iran it is seen as the first solution to problems and problems. The physician must first obtain the consent of the patient or his or her guardian or legal representative (in urgent cases) for all medical treatment, including surgery. Obtaining consent is not necessary) and in the next step observance of technical and scientific standards and governmental systems is required. The researcher concluded that: Permission and remorse in medical malpractice arising from Imamieh and Hanafi jurisprudence differs from legal jurisprudential perspective.
