چکیده:
با وجود آنکه در فقه اسلامی تنها از کتاب، سنت، اجماع و عقل به عنوان منابع استنباط نام برده میشود، اما قواعد و اصول استنباط و فقاهت مىتواند بسیار باشد. در این راستا، فقهای امامیه، توجه ویژهای به قواعد فقهی داشته و دارند. با این وجود هنوز برخی از قواعد فقهی که البته در استنباط بسیار سرنوشت ساز هستند، نظر فقها را به عنوان قاعده به خود جلب نکرده اند. هر چند در لابهلاى فتواها و استدلالهاى فقهى از این قواعد بهره بسیار برده شده است؛ ولی به صورت یک قاعده، مدون نگشته و حد و مرز آنها بوضوح تبیین نگردیده است. از این دست قواعد مىتوان به قاعده عدالت، قاعده سهولت، قاعده مساوات و.... اشاره کرد. در این مقاله، در صدد پاسخ دادن به این پرسش هستیم که آیا فقیه یا حقوقدان، خصوصأ در موارد سکوت، نقص و تعارض قوانین و یا در مقام اختلاف نظر دانشمندان، میتواند به قاعدهی عدالت استناد کند یا خیر؟ در مورد استناد به «قاعده ی عدالت» توسط فقها و حقوق دانان بیان میگردد که در استقرایی که صورت گرفته حدود هشتاد فتوا یا نظر حقوقی است که در آن موارد، فقیه یا حقوقدانان با تمسک به « قاعدهی عدالت» به صدور «فتوا» یا اظهار نظر حقوقی مبادرت کرده اند.
Although the sources of inference in Islamic jurisprudence are limited to books, traditions, consensus and reason, the rules and principles of inference and jurisprudence can be many. The jurisprudents of Imamiyyah have paid special attention to jurisprudential rules and have authored numerous works in this field. However, some of the jurisprudential rules, which are, of course, crucial to the inference, have not attracted the jurists' opinion as a rule. Although these rules have been widely used in the light of fatwas and jurisprudential arguments, they have not been codified as a rule and their boundaries have not been clearly elucidated. These are the rules of justice, the rule of equality, the principle of equality, and so on. Justice can be applied to jurisprudence as a comprehensive jurisprudential rule and eliminate the challenges of executing sentences and organize the inference of religious law based on it. In this article, to answer the question of whether the jurisprudent or jurist, especially in cases of silence, flaws, conflict of laws, or in the disagreement of scholars, can he invoke the rule of justice?, which states that there are about eighty fatwas or legal opinions in which the jurisprudent or jurist issues a "rule of justice" by issuing " Fatwa.
