چکیده:
در حقوق بینالمللء مفهوم حاکمیت خارجی دولت. استقلال و تساوی آن با دول دیگر است. ضابطه تشخیص دولت از
اجتماعات غیردولتی حاکمیت مطلق دولت است؛ به این معنا که قدرت دولت. قدرتی عالی, نامحدود و تبعیتناپذیر است.
حاکمیت را می توان اقتدار عالیه یک دولت در اتخاذ و اجرای تصمیمات دانست. اصل حاکمیت مطلق دولتهاء از جمله
مقتضیات برقراری نظم جهانی است. بنابراین احترام متقابل دولتها به استقلال و حاکمیت یکدیگر امری ضروری و لازم است.
از این دیدگاه, حاکمیت. موضوع حقوق داخلی است و این موضوع تنها تا آنجا به حقوق بینالملل مربوط میشود که به تعهدات
بینالمللی یک دولت در برابر سایر دولتها لطمهای وارد نسازد. با توسعه حقوق بینالملل از حاکمیت دولتها کاسته شد و
دولتها در بعضی موارد به نفع نظم بینالمللیء برخی محدودیتها را نسبت به حاکمیتشان پذیرفتند. یکی از مواردی که در
جهان امروز موجب بروز این محدودیتها شده است. مسئله حقوق بشر میباشد. در پژوهش حاضر به بررسی محدودیتهای
وارده بر حاکمیت دولتها از طریق اسناد مرتبط با نسل دوم حقوق بشر پرداخته شده و سعی شده به سوالات زیر پاسخ داده
شود: مفهوم حاکمیت چیست و نسل دوم حقوق بشر چگونه موجب محدودیت حاکمیت شده است؟
The concept of foreign sovereignty of the state, In international law is the autonomy and
equality with other states. The criterion for distinguishing the state from nongovernmental
societies is the absolute sovereignty; that is, the power of the state is a supreme, infinite, and
unreliable power. Sovereignty can be regarded as the supreme authority of a state in making
and executing decisions. The principle of absolute sovereignty of states is one of the
requirements for establishing world order. Therefore, the mutual respect of states to the others
independence and sovereignty is essential. From this point of view, sovereignty is a matter of
domestic law, and it only relates to international law so as not to prejudice one state's
international obligations to other states. With the development of international law, the
sovereignty of states has been reduced and governments have in some cases adopted some
restrictions on their sovereignty in favor of the international order. One of the issues that has
caused these restrictions in today's world is the human rights issue. The present study
examines the limitations on the sovereignty of governments through the Second generation of
human rights instruments and attempts to answer the following questions: What is the concept
of sovereignty, and how did the Second generation of human rights restrict sovereignty?
