چکیده:
فرزند کشی از جمله وقایعی است که از زمانهای دور تا عصر حاضر در بین جوامع مختلف به وقوع پیوسته است.گاه بیماری های روانی والدین منجر به این امر میشود و گاه فقر و اعتیاد موجب میشود که والدین فرزند خود را به قتل برسانند.همچنین ممکن است از ترس ناقص الخلقه متولد شدن فرزند و یا بیم از دست رفتن حیات مادر ، فرزند خود را در دوران جنینی سقط نموده و به زندگانی او خاتمه دهند. به هر ترتیب اگر پدر و مادری از روی عمد مرتکب قتل فرزند خود شوند فارغ از اینکه علت آن چه باشد مطابق با قانون مجازات اسلامی ایران وفقه امامیه حکم یکسانی در مورد آنها صادر نمیشود به نحوی که اگر پدر مرتکب این عمل گردد نمیتوان او را قصاص نمود و درمقابل، مادری که فرزند خویش را به قتل رسانده مستحق کیفر قتل عمد است. بنابراین پرسشی مهمی که در این زمینه طرح میشود این است که چرا در این زمینه باید حکم متفاوت صادر نمود و آیا این امکان وجود ندارد که مادر نیز همچون پدر معاف از کیفر قصاص باشد؟پرداختن به این مسأله از این حیث ضروری است که باتوجه به تدوین قانون مجازات اسلامی بر اساس فقه امامیه پاسخ شایسته به این پرسش مهم میتواند در روند قانونگذاری تاثیر گذار باشد. تحقیق حاضر برای حل این مسأله به بررسی متون فقهی و روائی فقه امامیه پرداخته و پس از طرح دو دیدگاه موافق و مخالف قصاص مادر معتقد است که میتوان مادر را نیز از مجازات قصاص رهائی بخشید.
Filicide is an even happened from ancient time to now in different societies. Sometimes, parents’ mental diseases lead to filicide and in other cases, poverty and drug addiction cause that parents kill their children. In the meantime, by fear of a malformed child or mother’s death, a child may be aborted and his/her life comes to an end. Anyhow, in Islamic punishment law and Emamieh jurisprudence, if parents kill their child, identical verdicts are not issued for them irrespective of the reason so that if father kills his child, he cannot be retaliated while if a mother kills her child, she is entitled with murder penalty. An important question is raised: why different verdicts are issued and isn’t it possible that mother can be exempted from retaliation as same as father? It is important to address this issue since Islamic punishment law in Iran is formulated based on Emamieh jurisprudence and a proper answer to this important question can be effective in legislation process. Present study examines jurisprudential texts and narratives of Emamieh jurisprudence and by introducing two opponent and proponent insights on mother’s retaliation, it is said that mother also can be saved from retaliation penalty.
