چکیده:
بررسی قرآن کریم و متون مرتبط با آن، همچون کتابهای تفسیر و منابع فقهی نشان میدهد که مسئله «ارث» یکی از موضوعات مهم اسلامی است. در قرآن کریم طی چندین آیه علاوه بر طرح شدن اصل مسئله ارث بسیاری از جزئیات آن نیز بیان شده است که این کاشف از توجّه شارع مقدس اسلام به ارث میباشد از سوی دیگر در بین مفسران و فقهای اخیر، آقای دکتر محمد صادقی تهرانی قابل توجهی از پژوهشگران قرآنی و فقهی به نقد و تحلیل نظریات ایشان پرداختهاند. این نوشتار گامی در همین راستا است. در آغاز پس از مباحث مقدماتی، زندگینامه و آثار نامبرده معرفی شد. سپس نظریات وی در مسائل ارث مرتبط با «ارث زن از ماترک شوهر» همراه با استدلالهای قرآنی با فقهی آنها ذکر گردید.از دیدگاه صادقی زن از عین زمین (و نه منحصراً قیمت زمین) ارث میبرد و در استحقاق ارث، فرقی میان زنان (دائم و غیردائم، پیر و جوان و کهنسال، مدخول بها و غیر آن، دارای فرزند و فاقد آن) وجود ندارد. تفصیل میان اموال منقول و غیرمنقول خلاف عقل، عدل و عرف است و در نهایت نمیتوان روایات مربوط به بحث ارث را بر آیات قرآن کریم مقدم نمود. این نظریات آقای طهرانی مورد توجه معاصران قرار گرفته است.مفسّرانی مثل آقای معرفت ره در بعضی مسائل ارث با نظریات ایشان موافقند و بسیاری از مفسّران و فقهای معاصر و اخیر به نقد یا مخالفت نظریات نامبرده پرداختهاند که وجوه استدلال موافقان و مخالفان به صورت موجز در این نوشتار بیان شده است.
A study of the Holy Qur'an and related texts, such as books on commentary and jurisprudential sources, shows that the issue of "inheritance" is one of the most important Islamic issues. In several verses of the Holy Quran, in addition to raising the issue of inheritance, many details have been stated that this revelation is due to the attention of the holy sharia of Islam to inherit. On the other hand, among recent commentators and jurists, Dr. Mohammad Sadeghi Tehrani can Quranic and jurisprudential scholars have criticized and analyzed their theories. This article is a step in this direction. At the beginning, after the introductory topics, the biography and works mentioned were introduced. Then, his views on inheritance issues related to "a woman's inheritance from her husband's estate" were mentioned along with Qur'anic arguments with their jurisprudence. From an honest point of view, a woman inherits from the same land (and not exclusively the price of the land) and in the right to inherit, there is a difference between women (permanent and non-permanent, old and young and old, priced and otherwise, with and without children) does not have. The detail between movable and immovable property is contrary to reason, justice and custom, and finally, the narrations related to the discussion of inheritance cannot be preceded by the verses of the Holy Quran. These views of Mr. Tehrani have been considered by contemporaries.
