چکیده:
مقابله یا معارضهی متناقض با مقصود، عنوانی است که در تعلیل و تأیید برخی گزارههای شرعی، در فقه شیعه، مانند منع قاتل از بهرهمندی از میراث مقتول، به کار رفته است. اهل سنت نیز، شتاب در تحقق امری، پیش از فرارسیدن زمان آن امر را، مستوجب معاقبهی به حِرمان دانستهاند. اگر چه، در قواعد فقه امامیه، سخن چندانی از این قاعده به میان نیامده و تنها برخی از ایشان، به تبع اهل سنت، دربارهی آن قلم زدهاند؛ اما، گسترهی کارکردهای این قاعدهی فقهی و امکان بهرهمندی از آن در مجازاتهای تعزیری، ضرورت واکاوی اصالت و صحت آن را روشن میکند. با تأمل در ادله و کاربردهای این قاعده در متون فقهی، قوام و استواری آن در شریعت متصور است و چنین به نظر میرسد که این قاعده، با شروطی، که از تحلیل و پالایش کاربستهای فقهی آن به دست میآید، قابلیت تعمیم دارد. در این پژوهش، با بهرهگیری از منابع اسنادی و به روش توصیفی ـ تحلیلی به اثبات اصالت و ساختارمندی این قاعده و تبیین مجرای آن در فقه شیعه پرداخته شده است.
Interference or contrast of contradictory with purpose is a principle that has been used in the casual inference and confirmation of some religious propositions in Shi’ite jurisprudence, such as the murderer’s prohibition of benefiting from the victim’s heritage. Sunnis also consider haste in actualization of an issue before its due time as resulting in disappointment. Although, in the principles of Imami jurisprudence, there was not much spoken of this rule, and only some of them, in following the Sunnis, have written about it, the expanse of the functions of this jurisprudential principle and the possibility of enjoying it in punishments clearly illustrates the necessity of verifying its authenticity and soundness. By contemplation on the evidences and applications of this rule in jurisprudential texts, its consistency and solidity is apparent in Shari'a, and it seems that this rule can be generalized to the conditions that are obtained from the analysis and refining of their jurisprudential applications. In this research, using documentary resources and analytical method has been addressed to prove the originality and structure of this rule and to explain its channel in Shi’ite jurisprudence.
