چکیده:
فقیهان در ثبوت دیه کامل برای جنین بعد از ولوج روح اتفاق نظر دارند، اما در مقدار دیه برای مراحل قبل از ولوج روح و تعداد این مراحل، اختلاف دارند. مشهور آنها به استناد قرآن کریم و روایات، پنج مرحله برای قبل از ولوج روح قرار دادند که عبارت است از نطفه، علقه، مضغه، عظام و تمامیت خلقت. آنها برای هر مرحله ـ به استناد روایات متعدد ـ دیهای خاص تعیین کردهاند. در عین حال در بسیاری از روایات برای مراحل مختلف رشد جنین، معیار زمانی ارائه شده است که بسیاری از فقیهان به علت تعارض این روایات با یکدیگر از فتوا بر اساس آنها صرف نظر کرده و در فتاوای خود معیار زمانی تعیین نکردهاند. در این نوشتار با استمداد از دیدگاه ابن ادریس کوشش شده حتی المقدور میان همه روایات در این باره جمع گردد و در نهایت معیار زمانی روشنی برای مراحل رشد جنین و دیه هر مرحله تعیین گردد. بر پایه آنچه در این نوشتار به اثبات رسیده برای هر روز رشد جنین، یک هزارم دیه کامل (یک دینار) تا مرحله ولوج روح که در 120 روزگی است ثابت میباشد. پس از ولوج روح، دیه کامل ثابت است. پس دیه جنین از یک دینار آغاز و تا هنگام ولوج روح که در چهار ماهگی است به 119 دینار میرسد. پس از آن 1000 دینار خواهد بود.
Foqaha have consensus of opinion on the proof of full diya[1] for the fetus when the soul enters body of the fetus; however, on the amount of diya for the stages before the onset of the soul and the number of these stages they are of different opinions. According to the Qur'an and narrations, foqaha set five stages before attaching soul to the fetus, which are notfeh[2], alaqah[3], mozghah[4], Izam[5], lahm[6] and one stage at the time of attaching soul (breathing spirit) to the body, i.e., khalqan akhar[7]. Accordingly, on the basis of various narrations, they have set a specific diya for each stage. Notably, for different stages of fetal development, in many narrations, a time criterion has been presented but many foqaha, due to the conflict between these narrations, have renounced to issue fatwa based on them and have not set a time criterion in their fatwas. Taking advantage of Ibn Idris' point of view, the present study has made an attempt to gather among all the related narrations as much as possible, and thus to determine a clear time criterion for the developmental stages of the fetus and the diya of each stage. According to what has been demonstrated in this article, for every day of fetal development, one thousandth of a full diya (one dinar) is fixed until the stage the spirit/soul is breathed into the fetus, which is on the 120th day. Right after this stage, the full diya is fixed. So, the diya of the fetus starts from 1 dinar and reaches 119 dinars by the time the soul is mature at four months. After that; that is, at the time of completion of the body and soul, it will be 1000 dinars.

Some commentators of the holy Quran interprete ‘khalqan akar’ as the time of creation of soul and blowing it to the fetus so that God’s creation is complete; while some others suggest that in this stage as the final stage, a totally different being has come to existence/creation by the Almighty Allah which is totally different from the sperm stage as the first stage of the fetus formation. Moreover, some other commentators stipulate that this stage as the final one is a different type of creation which is peculiar to human being and is different from that of all other creatures, and this is why nafs-e nateqeh (reasoning self) which means human as a reasoning and speaking creature enjoying the spiritual aspeect has uniquely inherited his soul from Allah’s soul.

قسم چهارم: چهار مرحله (نطفه، علقه، مضغه، روح) در روایت ضعیف یا صحیح (مجلسی، 1406ق: ص10، ص419) سعیدبن مسیب از امام زین العابدین (ع) آمده که برای نطفه که مدت آن بعد از استقرار در رحم چهل روز است، 20 دینار و برای علقه که مدت آن هشتاد روز است 40 دینار و برای مضغه که مدت آن صد و بیست روز است 100 دینار و برای پس از آن که روح در جنین دمیده شده، دیه کامل ثابت است (کلینی، 1365: ج7، ص347).
فتاوای آنها بدین قرار است: قول اول: نطفه 20، علقه 40، مضغه 60، عظام 80، لحم 100 و روح 1000 دینار مشهور فقیهان مانند شیخ مفید و شیخ طوسی در برخی آثارش به استناد قسم اول از روایات مذکور در بند 2، این قول را برگزیدهاند (مفید، 1410 ق، ص762؛ طوسی، 1400ق: ص778؛ ابن ادریس، 1410ق: ج3، ص416؛ نجفی، 1404ق: ج43، ص367؛ خمینی، 1408ق: ج2، ص597؛ خویی، 1418ق: ج42، ص490).
