چکیده:
زمینه و هدف: این مقاله خصوصی سازی پلیس در دریا را در قالب تفویض اختیارات پلیس توسط دولت ها و اتحادیه اروپا به کشتی های نهادهای خصوصی مورد بحث قرار می دهد. مسلماً، چنین خصوصیسازی در سالهای گذشته به طور قابل توجهی افزایش یافته است و سؤالات زیادی در حوزه ی حقوق بینالملل، از جمله سؤالات مربوط به سازگاری چنین رویهای با حقوق بینالملل، پیششرطهای حقوق دریاها برای اعمال اختیارات اجرای قانون توسط نهادهای خصوصی، وضعیت کشتیها و همچنین مسائل مربوط به مسئولیت بینالمللی و مصونیتها را مطرح کرده است.روش تحقیق: این پژوهش به روش تحلیلی- استنباطی انجام گرفته شده است.این مقاله به پرسشهای فوق میپردازد، از جمله؛ قانونی بودن این خصوصیسازی را بر اساس قوانین بینالمللی عمومی و مبانی قضایی که از طریق آن کشورها یا اتحادیه اروپا میتوانند به طور قانونی اختیارات پلیسی را به بازیگران خصوصی تفویض نمایند.نتایج و یافته ها: می توان نتیجه گیری کرد که علی رغم ویژگی نوآورانه این مدل رفتاری، این روش همچنان تابع اصول کلی حاکم بر اجرای قانون در دریا، از جمله اصول قانونی بودن و معقول بودن است.
Background and purpose: This article discusses the privatization of policing at sea in the form of the delegation of policing powers by governments and the European Union to the ships of private entities. Admittedly, such privatization has increased significantly in recent years, and many questions arise in the field of international law, including questions about the compatibility of such a practice with international law, the prerequisites of the law of the sea for the exercise of law enforcement powers by private entities, the status of ships and It has also raised issues related to international responsibility and immunities.Research method: This research was carried out by analytical-inferential method.This article addresses the above questions, including; The legality of this privatization is based on general international laws and judicial foundations through which countries or the European Union can legally delegate police powers to private actors.Results and findings: It can be concluded that despite the innovative nature of this behavioral model, this method is still subject to the general principles governing law enforcement at sea, including the principles of legality and reasonableness.
