چکیده:
حقوق و اقتصاد دو شاخه از علوم انسانی هستند که پیش از قرن 18 جدا از هم نبودند. با گسترش روش شناسی تجربی و غلبه آن بر اقتصاد به تدریج اقتصاد به صورت علم مجزا و بدون توجه به حقوق و نهادهای حقوقی مطرح شد. ظهور نهادگرایی قدیم و جدید و طرح بحث های حقوقی مبادله و هزینه آن ارتباط آن دو را رقم زد. از سوی دیگر، بهره گیری از روش اقتصاد برای تحلیل قانون و مقررات در چند دهه اخیر رشته میان رشته ای تحلیل اقتصادی حقوق را مطرح ساخته است. اقتصاد اسلامی حلقه ارتباطی بحث های فقه، حقوق اسلامی و اقتصاد است و باید برای گسترش خود ضمن توجه جدی به چارچوب های حقوقی فعالیت اقتصادی برای انتخاب قوانین صحیح یا انتخاب نظریه از میان اجتهادهای گوناگون افزون بر توجه به ادله شرعی به اثرهای اقتصادی نظریه حقوقی نیز نظر کرده و به کمک آن، نظریه کارا را انتخاب کند. این مقاله درصدد است نشان دهد؛ فقه اسلامی ریشه مکتب اقتصادی و محیط پرورش علم اقتصاد و از ارکان سامان یافتن نظام اقتصاد اسلامی است و به علت واقعی بودن اقتصاد اسلامی تصور جدایی این دو علم چه در بعد نظری یا عملی با ادبیات اسلامی سازگار نیست.
Economics and law are two sciences of the humanities that weren't apart from each other before 18th century. Economics became a separate science by developing experimental methodology and its domination on economics and appeared without attention to law and legal institutions. Old and new institutionalism advent and proposing cost and transaction law helped to their convergence. On the other hand the exploitation of economics method for analyzing law and regulations to propose a new interdisciplinary called law and economics in recent decades. Islamic economics is the connection of Fiqh، Islamic law، and economics. It should consider the law framework of economic activity to select accurate law or the theory among different diligences which the economic consequences of legal theory has been studied beside lawful evidence for selecting efficient theory. This essay shows that Islamic Fiqh is a basis for economic school، a climate for growing economics and pillars for settlement the Islamic economic system. Imagining these two sciences apart each other is inconsistence in Islamic literature either in theory or practice because Islamic economics is real.
