Abstract:
سیاست قانونگذار ایران در جهت پیشگیری از جرایم مواد مخدر همواره مبتنی بر پیشگیری کیفری و سرکوب گرانه بوده است به نحوی که در تعیین مجازاتها به میزان قبح اجتماعی عمل، شخصیت مرتکب، کرامت انسانی، نوع جرم و موازین حقوق بشری که از معیارهای تناسب سازی مجازات است توجه نشده است ضمن اینکه مجازات اعدام علاوه بر ناعادلانه بودن و نداشتن بازدارندگی موثر، در عمل اثرات نامطلوب اجتماعی و کاهش اعتبار بینالمللی کشور را نیز به دنبال داشته و موجب پیشگیری از جرایم مواد مخدر نشده است همچنین عدم تمایل قضات به صدور چنین احکامی، دلیلی بر ناعادلانه و نامتناسب بودن مجازاتهای مواد مخدر بالاخص اعدام است. بر این اساس مقاله حاضر با نگاهی انتقادی به سیاست جنایی تقنینی و قضایی ایران و نیز سایر کشورها در این خصوص، به این نتیجه میرسد که سیاست پیشگیرانه کیفری مقنن در سالهای گذشته به لحاظ خروج از تناسب و اعتدال در عمل موفق نبوده و حتی موجبات تضعیف مشروعیت مجازات اعدام فراهم آورده است. بنابراین قانونگذار درسال 96 با اینکه در الحاقیه ماده 45 تا در راستای کاهش این آسیبها گامهای موثری برداشته است معالوصف بازبینی مجدد در موارد باقی مانده مجازاتهای اعدام و و توسل به جایگزینهای مناسب ضروری مینماید. واژگان کلیدی:

Judges are also reluctant to issue such sentences. Is a reason for the unfair and dispropor-tionate nature of drug punishments, especially the death penalty. Accordingly, the present article with a critical look at the legislative and judicial criminal policy of Iran and other countries in this regard, concludes that the pre-ventive penal policy of the legislature in recent years in terms of out of proportion and moderation in practice has not been successful and even causes undermined of the legitimacy of the death penalty. Therefore, in 1396, alt-hough the legislature took effective steps to reduce these harms in the amendment to Article 45, however, it is necessary to reconsider the remaining cases of the death penalty and to resort to appropriate alternatives.
