Abstract:
پژوهش حاضر به موضوع تعهد دولتها به ایمن و پایدارسازی سکونتگاههای انسانی در مقابله با تغییرات اقلیمی در چارچوب حقوق بینالملل میپردازد. هدف از نگارش این پژوهش تبیین تعهدات حقوقی دولتها به ایمن و پایدارسازی سکونتگاهها در مقابله با تغییرات اقلیمی در چارچوب حقوق بینالملل است. این پژوهش به صورت کیفی، تحلیلی، توصیفی و به صورت کتابخانهای انجام گرفته است. تغییرات اقلیمی از جمله عواملی است که از دههها قبل پایدارسازی سکونتگاهها را با چالش روبهرو ساخته و خسارات بسیاری را به محیطزیست بشر وارد آورده است. بنابراین دولتها در قالب معاهدات و کنوانسیونهای زیستمحیطی سعی در کنترل این پدیده نمودهاند. گرچه کنوانسیونها و اسناد حقوقی بسیاری به تعهدات دولتها به پایداری سکونتگاهها در مقابله با تغییرات اقلیمی و همچنین کاهش بلایای طبیعی که همگی سکونتگاههای انسانی را دچار چالش میسازد، تاکید نمودهاند و هر یک از دولتهای عضو تعهداتی را جهت مقابله و کنترل تغییرات اقلیمی و کاهش انتشار گازهای گلخانهای و از طرفی سازگاری محیطزیست بشری با پدیده تغییرات اقلیمی همچون ایمنسازی سکونتگاهها و اماکن بشری عهدهدار شدند، اما به دلیل ویژگی غیرالزام آوریشان چندان مورد توجه دولتها نیستند. اما در هر صورت میتوانند به عنوان سازوکاری موثر در کنترل تغییرات اقلیمی و ایمن نمودن سکونتگاهها مثمر ثمر باشند.
The present study addresses the commitment of states to the safety and sustainability of human settlements in the face of climate change within the framework of international law. The purpose of writing this study is to explain the legal obligations of states to the safety and sustainability of settlements in the face of climate change in the framework of international law. This research has been done qualitatively, analytically, descriptively and as a library. Climate change is one of the factors that has made the stabilization of settlements a challenge for decades and has caused a lot of damage to the human environment. Therefore, states have tried to control this phenomenon in the form of environmental treaties and conventions. However, many conventions and legal instruments emphasize the commitment of states to the sustainability of settlements in the face of climate change, as well as the reduction of natural disasters, all of which affect human settlements, and each member state has obligations to combat and control climate change. They have been responsible for reducing greenhouse gas emissions and adapting the human environment to the phenomenon of climate change, such as securing human settlements and places, but due to their non-binding nature, they are not much considered by states. But in any case, they can be effective as an effective mechanism in controlling climate change and securing settlements.
