Abstract:
زمینه و هدف: دیپ فیکها یا جعلهای پیچیده رایانهای یکی از دستاوردهای اخیر جامعه بشری هستند. این پدیده به افراد اجازه میدهد تا فیلمها، تصاویر و صوتهایی غیرواقعی را با اهداف و کارکردهای متنوع خلق کنند. برخی از این کارکردهای آن بخشی از حیات اجتماعی جامعه را تشکیل میدهند؛ اما سوءاستفادههای متعددی از آن نیز قابل تصور است. همین مسأله چالشهایی را در رابطه با نوع واکنش کیفری نسبت به آن ایجاد میکند.روش: پژوهش حاضر با روش توصیفی و تحلیلی انجام شده است.یافتهها و نتایج: معاهدات حقوق بشری معیارهایی را معرفی میکنند که دولتها باید در اتخاذ هر اقدام حمایتی از حقوق و آزادیهای بشری مد نظر قرار دهند. این معیارها در مورد دیپ فیکها نیز باید در نظر گرفته شود. با این وجود جدید بودن فناوری ساخت و همین طور کارکردهای متنوع آن باعث شده تا مرزهای دقیق میان مصادیق مجرمانه و مجاز آن نامشخص باشد. در این پژوهش نتیجه گرفته شده است که اولاً در نظام حقوقی ایران جرمانگاری مشخصی برای این دست از جعلها انجام نشده است و دوماً علیرغم اینکه بسیاری از مصادیق آن تحت پوشش برخی از جرایم قرار میگیرد، نظام کیفری ایران با واقعیت ها و الزامات خاص این پدیده همخوانی ندارد.
Background and Aim: Deep fakes or complex computer forgeries are one of the recent achievements of human society. This phenomenon allows people to create unrealistic videos, images and sounds with a variety of purposes and functions. Some of these functions are part of the social life of society. But many abuses are also conceivable. This raises challenges regarding the type of criminal response to it.Method: The present study was conducted by descriptive and analytical methods.Findings and Results: Human rights treaties set out the criteria that governments should consider in taking any action to protect human rights and freedoms. These criteria should also be considered for deep fakes. However, the new construction technology as well as its various functions have made the exact boundaries between criminal and legal instances unclear. This study concludes that, firstly, in the Iranian legal system, there is no specific criminalization for such forgeries, and secondly, despite the fact that many of its examples are covered by some crimes, the Iranian penal system with The specific facts and requirements of this phenomenon are inconsistent.
