چکیده:
حق دسترسی به اطلاعات یکی از اصول بنیادین حکومتهای دموکراتیک و از مصادیق مهم نسل اول حقوق بشر و تضمین کننده حقوق شهروندی است. حقوق بشر به عنوان حقوق پایه و اولیه، تکلیف و تعهدی بنیادین است که مشروعیت آن مشروط به طرح و تصریح در قانون اساسی نیست اما حقوق شهروندی تنها در یک رابطه حق و تکلیفی وضعی قابل تحقق است و به موازات هر حقی برای شهروند، تکلیفی نیز وجود دارد. شناسایی و تضمین حق مزبور با گسترش سریع شبکههای اجتماعی به یکی از مهمترین مصادیق تحقق حقوق شهروندی در نظام حقوقی ایران تبدیل شده است. علیرغم تصویب قانون انتشار و دسترسی آزاد به اطلاعات سال 1388، تاکنون ضمانت اجرایی خاصی اندیشیده نشده است و نقاط ضعفی مانند ابهام و اجمال در تعاریف و مفاهیم، فقدان تشکیل کمیسیون موضوع ماده 18، از عوامل عدم تحقق حق مزبور است. پرسش اصلی این است که اصول حاکم بر مقرراتگذاری نظام حقوقی ایران در حوزه حق دسترسی به اطلاعات چیست و تاثیر آن بر تحقق حقوق شهروندی چگونه است؟ فرضیه اصلی این است که آیا ظرفیتشناسی مقرراتگذاری نظام حقوقی ایران میتواند در حوزه حق دسترسی به اطلاعات و بر تحقق حقوق شهروندی تاثیرگذار باشد.
