چکیده:
در قوانین و گزارشهای کارشناسی رسمی در سه دهه گذشته همواره بر تسریع خصوصیسازی تاکید شده است. این در حالی است که بعد از سپریشدن هر دوره از خصوصیسازی، همگان درباره اشتباهها یا کجرویهای آن در دورة قبل صحبت کردهاند. در واقع در هر برهه اذعان شده است که خصوصیسازیهای گذشته صحیح نبوده است و همزمان گمان برده شده است که آیندة خصوصیسازی برای اقتصاد کشور نویدبخش خواهد بود. در این مقاله با مطالعة گزارشهای کارشناسی رسمی، مسیر طیشدۀ خصوصیسازیها را ارزیابی میکنیم و در توضیح این مسیر، در مقابل رویکردی که اصلاح خصوصیسازی را از طریق راهحلهای حقوقی و دیوانسالارانه پیگیری کرده است، استدلال میکنیم که قوانین توضیحدهنده و تعیینکنندة مسیر خصوصیسازی نیستند، زیرا خود نیازمند توضیحاند و توازن نیروهاست که قوانین را توضیح میدهد. عملکرد دیوانسالاری را نیز بدون توازن نیروها نمیتوان توضیح داد. بر این اساس، این فرضیه را مطرح میکنیم که ایرادهای مشاهدهشدة خصوصیسازی ناشی خطاهای انسانی یا سازمانی یا برخی اعراض خصوصیسازی اجراشده نیست، بلکه ناشی از اصل خصوصیسازی است. بر این اساس، در پایان با توجه به مشکلات خصوصیسازیها و با ارجاع به اصل ۴۴ قانون اساسی که بخش تعاونی را همعرض دو بخش دولتی و خصوصی قرار داده است، پیشنهاد میشود «تعاونیسازی» بهمثابه مسیر بدیل واگذاریها بنگاههای دولتی به رسمیت شناخته شود.
The facilitation of privatization has always been emphasized in laws and official expert reports over the last three decades. However, after each privatization period, everyone keeps talking about its mistakes or deviations in the previous period. In fact, it has always been acknowledged that past privatizations have not been principled, and it has always been speculated that the future of privatization will be promising for the economy of the country. In the present study, using the official expert reports, the progress of privatization is evaluated and while explaining this process, regarding the approaches that pursue privatization reforms through legal and bureaucratic solutions, it is argued that laws do not explain and determine the process of privatization, because they, in turn, need to be explained, and it is the balance of power that explains the laws. The function of bureaucracy cannot also be explained without the balance of power. Accordingly, it is hypothesized that the observed flaws in privatization are not the result of human or organizational errors, or some of the flaws carried out in the privatization, but of the nature of privatization itself. Accordingly, in the end, given the problems of privatization and referring to Article 44 of the Constitution, which considers the cooperative sector as important as public and private sectors, " cooperativization " is recommended to be recognized as an alternative for the transfer of state-owned enterprises.
