چکیده:
انتشار مواد هستهای در زمرة جلوههای جرایم زیستمحیطی میباشد که از ابعاد تروریستی و غیرتروریستی برخوردار است. دراینزمینه، کنشگران نظام حقوق بینالملل با تصویب کنوانسیونهای حفاظت فیزیکی از مواد هستهای و سرکوب اعمال تروریسم هستهای بهترتیب در سالهای 1979 و 2005، جرمانگاری ابعاد غیرتروریستی و تروریستی انتشار مواد هستهای را در دستور کار قرار دادهاند. در این خصوص، قانونگذار ایران در سال 1392، پخش مواد خطرناک در سطح گسترده را بهعنوان یکی از مصداقهای جرم حدی افساد فیالارض قرار داد. سوای استفاده از واژهها و عبارتهای ابهامآمیز، لزوم تحقق نتیجه مجرمانه و داشتن سوءنیت خاص باعث شده است تا پوشش ناقصی از حیث انطباق انتشار مواد هستهای با حد افساد فیالارض بهوجود آید؛ محاربه و تهدید علیه بهداشت عمومی در زمره جرایم دیگری هستند که هرکدام از چالشها و نقصهایی در پاسخ به انتشار مواد هستهای برخوردار هستند. در سوی مقابل، سیاستگذاران قانونگذاری فدرال ایالاتمتحده آمریکا بهنحو روشن و کامل، جرمانگاری انتشار مواد هستهای را در ابعاد تروریسم هستهای و غیر آن، بهصورت توامان مدّنظر قرار دادهاند؛ با این اوصاف، در طی جستار حاضر تلاش بر آن است تا با بررسی مقررات ایران و ایالاتمتحده آمریکا، واکنش کیفری منسجم و متناسبی با اعمال یادشده موردترسیم قرار گیرد.
The dispersal of radioactive material is one of the environmental
crimes that has both terrorist and non-terrorist dimensions. In this
regard, the activists of the international law system with the
ratification of the conventions on the physical protection of nuclear
materials and suppression of acts of nuclear terrorism in 1979 and
2005, respectively, considered non-terrorist and terrorist dimensions
of dispersal of radioactive material. In this way, the legislator of Iran
in 2013, considered a wide range dispersal of hazardous substances as
one of the instances of Efsade-fel-arz. In addition to the use of
ambiguous words and phrases, the necessity of result of the criminal
offense and special malice has led to incomplete coverage in terms of
dispersal of radioactive material. Muharebeh and threats against
public health are other crimes that have challenges and deficiencies in
response to the dispersal of radioactive substances. On the other hand,
US Federal Lawmakers have clearly and completely criminalized
dispersal of radioactive material in both terrorist and non-terrorist
dimensions. In the meantime, the purpose of this paper is to review the
laws of Iran and the United States against dispersal of radioactive
material and then introduce a proper criminal reaction about
aforementioned act.

در این خصوص ، قانونگذار ایران در راستای مقابله با انتشار مواد هسته ای رویکرد مـبهم و ناقصی را برگزیده است ؛ بدین سان ، اگرچه با انشای جرم حدی افساد فی الارض در مـاده ٢٨٦ قانون مجازات اسلامی ، عنوان مجرمانه «پخش مواد خطرناک » وارد ادبیـات حقـوق کیفـری ایران شد ولی ابهام ها و نارسایی هایی که بر ماده قانونی مذکور مترتب است ، باعث شده است تا نتوان درمقابل آلودگی هسته ای ، بازدارندگی مناسبی را ایجاد نمود.

با این مراتب ، پرسشی که در اینجا فراروی مخاطب قرار می گیـرد، آن اسـت کـه راهبـرد کیفری مناسب برای مقابله با انتشار مواد هسته ای دایر بر چه ابعادی است ؟ در مقام پاسخ باید گفت ، جرم انگاری صریح انتشار مواد هسته ای در ابعـاد غیرتروریسـتی (بـه عنـوان یـک جـرم زیست محیطی ) و تروریسم هسته ای همراه با مجازات های متناسب به عنـوان راهبـرد کیفـری سنجیده و در قبال اعمال یادشده مورداحتساب قرار می گیرد.
