چکیده:
زمینه و هدف: یکی از جنایات مهم و سنگین بین المللی، جنایت تجاوز ارضی است که محاکـم داخلی کشورها با تکیه بر اصـول حقوقی مقبول در رسیدگی به آن مواجه با چالش های متعدد هستند.مواد وروش ها: این تحقیق از نوع نظری بوده، روش تحقیق به صورت توصیفی تحلیلی می باشد و روش جمع آوری اطلاعات به صورت کتابخانه ای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است. یافته ها: محاکم داخلی کشورها علی رغم اشکال پنج گانه صلاحیتی محاکم تحت شرایطی قادر به رسیدگی به تجاوز ارضی می باشد لیکن در این راستا با موانع و چالش های متعددی مثل تشخیص متجاوز و مسولیت داشتن در موضوع تجاوز و نیز با حملات سایبری وبیولوژیکی مواجه می باشند.ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.نتیجه گیری: عدم اجرای موفق صلاحیت محاکم داخلی بر این جنایت به دلیل وجود موانع و چالشهای متعدد می باشد که اگر از توجه به نقطه نظرات و دیدگاههای موجود راه حلی برای آن اتخاذ نگردد، محاکم ملی نخواهند توانست به نحو شایسته به این جنایت رسیدگی نمایند.
Background and purpose: One of the most important and serious international crimes is the crime of territorial aggression, which the domestic courts of the countries are facing many challenges based on accepted legal principles.Materials and methods: This research is of a theoretical type, the research method is descriptive and analytical, and the method of collecting information is library-based, and it was done by referring to documents, books, and articles.Ethical considerations: In all stages of writing the present research, while respecting the originality of the texts, honesty and trustworthiness have been observed. Findings: Despite the five forms of court jurisdiction, the domestic courts of the countries are able to deal with it under certain conditions, but in this regard, they face many obstacles and challenges, such as identifying the aggressor and being responsible for the issue of aggression and biological attacks.Conclusion: The failure of the domestic courts to successfully implement the jurisdiction over this crime is due to the existence of many obstacles and challenges.
