چکیده:
عصر حاضر مملو از جنگ های منطقهای در خاورمیانه است و دفاع از سرزمین و کیان ایران اسلامی بر اساس تئوریهای ژئواستراتژیک، محدود به جغرافیای این کشور نیست و در این رهگذر مسئله چگونگی دفاع از کشور در این مقطع زمانی مورد تأمل محافل و اندیشه ورزان عرصه حقوق و سیاست و به تعبیری دیگر، دیپلماسی و میدان است. این تحقیق به روش توصیفی- تحلیلی با استفاده از ابزار کتابخانهای به این نتیجه رسیده که نگاهی به مبانی فقهی نشان میدهد که دفاع مشروع و به عبارتی، متوسل شدن به زور به خاطر دفع ضرر واجب است. مصداق عینی این موضوع توسل به زور به منظور دفاع بوده که از استثنائات اصل منع توسل به زور است؛ البته دیدگاههای فقهی در مورد موضوع مذکور گاهی با اختلافاتی مشهود است. وجوب جهاد تدافعی مشروط به رهبری معصوم (ع) یا نایب خاص یا عام وی نیست، لکن با فرض تشکیل حکومت اسلامی مقتدر که رهبری عادل و مطاع در رأس آن است، در صورت امکان و عدم خسارت جدی در تأخیر دفاع تا حصول اذن، دفاع با اذن و مطابق نظر رهبری مشروع و مصلحت سنجی او صورت خواهد گرفت. مقاله حاضر ضمن پرداختن به اختلاف دیدگاهها در این خصوص درصدد تبیین دفاع مشروع از دیدگاه اسلام، مبانی فقهی آن و گستره جهاد تدافعی شامل دفاع از اسلام درمقابل فتنه گری دشمنان، دفاع از دار الاسلام و کیان اسلامی، دفاع از بلاد اسلامی و نیز دفاع از اتباع دولت اسلامی و مستأمنین و نیز شرایط و محدودیتهای جهاد تدافعی بوده و برآن است تا محور مباحث را حول دیدگاههای امام خمینی قرار دهد.
The present era is full of regional wars in the Middle East and the world, and the defense of the land and existence of Islamic Iran is not limited to the geography of the country according to geostrategic theories. Thinkers are in the field of law and politics, in other words, diplomacy and the field. It is clear that defending oneself against the aggression of others is logical and narrative, and only aggression against others is considered distasteful. A look at the principles of jurisprudence shows that legitimate defense and the use of force are necessary to prevent harm. It is obvious that the present article, while addressing it, seeks to explain the legitimate defense from the perspective of Islam, its jurisprudential principles and the scope of defensive jihad, including; Defending Islam against the sedition of the enemies; Defending Dar al-Islam and defending the citizens of the Islamic State and the trustees and the conditions and limitations of jihad is defensive and intends to focus on the views of Imam Khomeini.
