چکیده:
استدلال برپایهی ممنوعیت اجتهاد در برابر نص، بر وجود معنایی پیشینی، صریح، معین، قطعی، محصّل، متیقن و مستقل از خواننده و تفسیرگر تأکید دارد. آنچه در قالب این گزاره مطرح میشود، خود، بر رویکرد تفسیریِ مفسر- سوژه متکی است. پژوهش حاضر که با رویکرد توصیفی تحلیلی و با استناد به منابع کتابخانهای انجام شده، نشان میدهد چنین نگرشی دربرگیرندهی همهی رویکردهای تفسیری نبوده و نمیتواند بهعنوان قاعدهای اصولی- تفسیری محل استناد باشد؛ زیرا جدای از برداشتهای متفاوت از مفهوم نص، چگونگی نصنامیدن یک مصداق در مقام اثبات نیز محل اختلاف است. همچنان که باید میان اجتهاد در برابر ظاهر و اجتهاد در برابر روح و مقصود نص هم تفکیک قایل شد. قاعدهی اصولیِ «هر حکمی دائرمدار علتی است که بر اساس آن وضع شده است» محدودیت کاربست گزارهی ممنوعیت اجتهاد در برابر نص را موجب میشود؛ مانند عدم قطع دست سارق در سال قحطی و تأخیر در اجرای حد سرقت در موارد دیگر.

This article research, which was conducted with a descriptive-analytical approach and citing library sources, shows that such an attitude does not include all interpretive approaches and cannot be cited as a principle-interpretive rule; Because apart from the different understandings of the concept of text, how to call the example in the position of proof is also a point of disagreement . Also, a distinction should be made between ijtihad against the appearance and ijtihad against the spirit and meaning of the text. The basic rule of "Every ruling is basis on the reason on which it was established" limits the application of the prohibition of ijtihad against the text; Such as not cutting off a thief's hand in a year of famine and delaying the implementation of the sentencing theft in other cases.
