"اما این انسان از دو حیث با انسان حقوق بشر غربی تفاوت دارد: نخست آنکه انسان در حقوق بشر اسلامی،مطلقا آزاد نیست و آزادی ویدر دو بعد تعریف میشود:نخست آزادی وی در برابر افراد هم نوع خود وتکلیف و رابطه متقابل او در برابر آنها،و دوم آزادی و تکلیف در برابرخداوند.
چالش اساسی در بحث مشروعیت حقوق بشر غربی نیز به موضوع«تشخیص»برمیگردد و اینکه آیا انسان،که بههرحال و با لحاظ همهشرایط،باز هم انسان شمرده میشود،میتواند صلاح و فساد خویش راتشخیص بدهد یا نه؟گفته شد که در سنت غربی،مرجع مشروعیت نهگزارهها و آموزههای ورای بشری،که خود فرد و خواستههای او دانستهشده است؛اما این عبارت به واکاوی بیشتری نیازمند است.
شاید در نگاه عمومی،تقوای منظور نظر اسلام در بحث کرامتانسانی،تفاوتی با بدیل غربی آن در هدف و مقصود(بزرگداشت و رعایتکرامت انسان)نداشته باشد،اما دقت در این نکته که کرامت تعریف شدهدر فلسفه حقوق بشر غرب،ابتنایی صرفا بشری دارد و در حقیقت رابطهایکاملا طرفینی میان افراد بشر بدون مرجعیت فرابشری است،ما را به ایننکته رهنمون میسازد که موضع حق و تکلیف در دو نهاد متفاوت است وآنچه در غرب برای بشر به عنوان حق(اعم از حقوق طبیعی و قراردادی)لحاظ میشود،تنها در سایه تکلیف او در مقابل خلقت و خالق معنامییاید و رعایت و یا عدم رعایت آن به استحقاق پاداش و کیفر میانجامد.
اما آیا اخلاق و گزارههای اخلاقی که در غرب بخش مهمی ازحقوق بشر را پوشش میدهد،نمیتواند جایگزین گزارههای شرعی دراسلام شود؟پاسخ از دو جهت منفی است:نخست آنکه اخلاق نیز درغرب مانند حقوق،مبنایی جز قراردادهای مبتنی بر عرف ندارد و از اینحیث،الزامآوری آن تنها به قدرتمندی حکومت برمیگردد؛یعنی چوناخلاقی فاقد مبانی فرابشری است،لزوم عمل به گزارههای آن،بسته بهضامن اجرایی آن است،نه اینکه در نهاد و وجود فرد الزامآور باشد."
