Today, selection process of very high importance in Management Science and the development of human force . Many experts and experts in this field is one of the main reasons for the growth and or recession organizational performance as a result of the selection process and the role of the workforce in achieving organizational goals , and critical of the recruiting process system have special emphasis . After the Islamic revolution in Iran , in order to attract committed forces and expert in ministries and governmental organizations in the country , that was it . Although such mechanisms are in other countries in the world, and many of the internal and external experts stressed the necessity of such a process in order to health administrative system and increase its performance , but the issue by some external and internal currents , including human rights organizations such as Amnesty International and the International Labor Organization serious criticism ; so that in the last few years, a group of internal currents to eliminate the mechanism and international organizations for Amnesty demanded to remove it . In this paper attempts to look at the history of this issue in Iran and some countries, the most important characteristic of this process, and the selection missions in the process of hiring a country and the possibility of filing a lawsuit against them to pay the invasion and confirmed the necessity of selection process in the country, the necessary reforms on the recommendation of the current system.

Review of literature In an article entitled legal evaluation of recruitment selection, Naghashi (2012) states: Article 2 of the selection Law of teaches has considered general criteria for moral, political, and religious selection of teachers and considers believing in Islam or a religion mentioned in the Constitution as vital.
