عقد اجاره از منظر فقهی، به دو صورت اعیان (دارایی فیزیکی) و شخص (دارایی انسانی) ممکن است. در اجاره اعیان، امکان اجاره دارایی بهصورت کالای تولیدی (سرمایه فیزیکی) است؛ اما مالالاجاره در اجاره شخص، نیروی کار است که فرد میتواند کار خود را به فرد حقیقی یا حقوقی اجاره دهد. بند «ب» ماده 11 آییننامه اجرایی صکوک اجاره مصوب مرداد 89، دارایی قابل قبول جهت انتشار اوراق اجاره را زمین، ساختمان و تأسیسات، ماشینآلات و تجهیزات و وسایل حملونقل عمومی برشمرده که از لحاظ فقهی، اجاره اعیان و از منظر اقتصادی سرمایه فیزیکی است. در واقع با وجود ظرفیت فقهی اجاره شخص، همچنین مواد 512 تا 518 قانون مدنی در باب اجاره شخص، از این ظرفیت در طراحی صکوک اجاره استفاده نشده است. از آنجا که سازمان زندانها مکلف شده بر اساس ماده 122 آییننامه اجرایی اداره زندانها، مصوب آذر 1384 (با اصلاحیههای آن)، منابع مالیِ حرفهآموزی و اشتغال محکومان را تأمین کند، در صورت استفاده از صکوک اجاره مبتنی بر سرمایه انسانی، میتوان بخشی از هزینههای اداره زندان جهت توسعه اشتغال برای زندانیان را از طریق تأمین مالی صکوک اجاره سرمایه انسانی زندان، به پشتوانه نیروی کار و نه پشتوانه بودجه و منابع دولتی، محقق ساخت. این تحقیق بر اساس روش تحلیلی- توصیفی به ابعاد فقهی- اقتصادی صکوک اجاره شخص (سرمایه انسانی) پرداخته و به پشتوانه اشتغال زندانیان از طریق صکوک اجاره سرمایه انسانی، الگوی عملیاتی جدیدی را برای تأمین مالی زندانها ارائه کرده است.
