بررسی ضمانت اجراها و ارتباطی که به طور مستقیم و غیرمستقیم در حقوق افراد دارد از اهمیت بسزایی برخوردار است. برخلاف دیدگاه های سنتی و بعضا افراطی که بر مدار سلب وجودی عناصر حقوقی دور میزند، شایسته است حقوق اشخاص دخیل در عناصر حقوقی را در کنار اشخاص ثالث موردتوجه قرار داد و حتی الامکان از زوال عناصر حقوقی صرفا با توجیه منافات داشتن با حقوق اشخاص ثالث پرهیز کرد. توجیه ضمانت اجرای عدم قابلیت استناد قابلیت چنین رویکردی را دارد؛ چراکه حقوق اشخاص ثالث و هم حقوق متعهدین عناصر حقوقی را موردتوجه قرار میدهد و سعی در جمع حقوق اشخاص دارد به جای این که حقوق یکی را بر دیگری ترجیح دهد. در این راستا در جستار حاضر با توجه به پیشینه فقهی به مبانی عدم قابلیت استناد و مصادیق منطبق با آن پرداخته شده است. به هرحال باید افزود که میتوان ضمانت اجرای عدم قابلیت استناد را در منابع فقهی نیز مشاهده کرد و وصف عاریتی بودن آن از حقوق غربی را از ذهن زدود و به عنوان ضمانت اجرای عمومی مساعدتر موردپذیرش قرار داد.
It is important to examine the performance guarantees and the relationship that is directly and indirectly involved in the rights of individuals. On contrary to traditional and sometimes extremist views that exclude the existence of legal elements, it is appropriate to consider the rights of persons involved in legal elements alongside third parties and, as far as possible, to reduce legal elements only by justifying their opposition to the rights of third parties. Justifying the guarantee of the impossibility of invoking a citation is capable of such an approach. This is because the rights of third parties as well as the rights of the obligees take into account the legal elements and try to collect the rights of individuals instead of preferring the rights of one over the other. In this regard, in the present study, according to the jurisprudential background, the principles of inability to cite and relevant examples have been addressed. However, it should be added that the guarantee of the impossibility of citation can also be seen in jurisprudential sources, and the description of its borrowing from Western law has been forgotten and it has been accepted as a more favorable guarantee of public execution.
