در هر جامعه (از نگاه فقیه شیعه یا فقه اهل سنت ) متفکران سیاسی می کوشند که مسائل ومشکلات سیاسی را بر مبنا وچارچوب فلسفه سیاسی وریشه های فقه حکومتی خود پاسخ گویند از این رو هر حکومتی می کوشد مشروعیت خویش را بر پایه فلسفه سیاسی خاصی توجیه کند.نیاز به احکام حکومتی، نسبت میان احکام شرعی و احکام حکومتی، جعل و صدور فرامین و قوانین در جامعه اسلامی با تکیه بر مبانی دینی از مسائل مهمی هستند که لازم است توجیه شرعی کافی و مناسب داشته باشند. هر دو دیدگاه اعتقاد دارند «حفظ نظام» و جایگاه آن باید در چهار چوب شریعت باشد، اما با دقت و تأمل در مصلحت فقه اهل سنت، در می یابیم که تشخیص آن ها ظنی است و مصلحت مظنونه هیچگاه مقاصد شریعت را برآورده نمی کند ؛ چون تطبیق آن کلیات بر افراد خارجی و مسائل مستحدثه و نو ظهور کار آسانی نیست ؛ اما در فقه شیعه به برکت عترت و روایات بسیار معصومان به اجتهاد ظنی حاکم اسلامی که با نصب عام از طرف معصوم مشروعیت یافته،نیازهای حقیقی بشر در عرصه های گوناگون پاسخ گفته می شود.بنابراین مسئله مشروعیت در تحقق اصل «حفظ نظام» نقطه اختلاف بین فریقین است .
