خلاصة:
تبعیض جنسیت از چالش های حقوق خانواده است که با وجود تدوین مقررات داخلی وخارجی مقررات ، کمتر به حل و توجیه عدم تبعیض در جنسیت در حقوق اسلام نائل گشته ایم ، این مقاله در صدد است با روشی تحلیلی – توصیفی به شیوه کتابخانه ای ، جایگاه خانواده را در فقه اسلام ، حقوق شهروندی و کنوانسیون رفع تبعیض علیه زنان بررسی نماید.در این مقاله با تبیین مبانی فقه اسلام و حقوق شهروندی وکنوانسیون رفع تبعیض ، درپی پاسخ به این سوال هستیم که تحکیم بنیان خانواده درکدام یک از موارد مذکور ، مورد توجه واقع شده است ودر نهایت به تبیین مبانی اختلاف فقه اسلام و کنوانسیون رفع تبعیض علیه زنان بپردازیم . بابررسی های صورت گرفته دریافتیم که ماهیت ایجاد کنوانسیون رفع تبعیض برقراری تشابه کامل میان زن و مرد، فارغ از جنسیت آن ها و متفاوت از فقه اسلام است . یافته های دراین مقاله نشان می دهد که در فقه اسلام جایگاه خانواده و منزلت والای آن با توجه به اصول عدالت،حکمت، فطرت و مصلحت، بیشتر مورد توجه قرار گرفته است. با وجود اینکه این دو مهم در بسیاری موارد با یکدیگر دارای تشابه هستند اما لازمه ی برطرف نموندن اختلافات کنوانسیون مربوطه وفقه اسلام درحقوق خانواده تغییر مبانی ونگرشهای این دو است که بنظر می رسد دست یافتنی نباشد.
Gender discrimination is one of the challenges of family law that despite the development of internal and external regulations, we have failed to resolve and justify non-discrimination in gender in Islamic law. In Islamic jurisprudence, citizenship rights and the Convention on the Elimination of All Forms of Discrimination against Women. Finally, we will explain the differences between Islamic jurisprudence and the Convention on the Elimination of All Forms of Discrimination against Women. Through our studies, we found that the nature of the Convention on the Elimination of All Forms of Discrimination is to establish complete similarities between men and women, regardless of their gender and different from Islamic jurisprudence. Findings in this article show that in Islamic jurisprudence, the position of the family and its high status have been given more attention according to the principles of justice, wisdom, nature and expediency. Although these two important issues are similar in many cases, but the need to resolve the differences between the relevant convention of Islamic jurisprudence in family law is to change the principles and attitudes of the two, which does not seem to be achievable.
