یکی از مهمترین تقسیمهای جرائم از جهت عنصر مادی، تقسیم آن به جرم مستمر و جرم آنی است. جرم مستمر جرمی است که با تمام عناصر آن، لحظهبهلحظه تکرار شده، هیچ نقطه پایانی جز قطعِ استمرار، برای آن قابل تصویر نیست؛ اما این تعریف برخلاف اصل تفسیر به نفع متهم در حقوق کیفری است و در فقه امامیه نیز گستره اصل برائت را محدود میکند. در فقه امامیه بیانی درباره جرم مستمر وجود ندارد، ولی پذیرش آن و برقراری آثار محدود کننده برای متهم به واسطه آن، در تعارض با برخی اصول فقهی است. با تأمل در آرای فقها در جرائم قابل تعزیر، همچنین حدود، قصاص و جرائم مستوجب دیه، روشن میشود هیچکدام به رفتاری که در طول زمان استمرار داشته و تا انقطاع رفتار مجرم تحقق داشته باشند، اشارهای ندارند. پژوهش حاضر که با روش توصیفی-تحلیلی و با استناد منابع کتابخانه انجام شده است، استمرارِ جرم مستمر و در پی آن، شمولِ قانونِ لاحق با مجازاتِ شدیدتر نسبت به جرم مزبور در ماده 10 قانون مجازات اسلامی را نقد کرده و بنا بر اصل تفسیر به نفع متهم و آموزههای فقه امامیه، عدم وجود جرم مستمر و مخالفت آن با اصل برائت را اثبات ککرده است. در این راستا، ضرورت دارد ماهیت جرم مستمر به عنوان یکی از مواضع تضییع حقوق متهم مورد بررسی شود.

By reflecting on the manifestations that great jurists have presented of punishable crimes, prescribed by Sharia, limits, retribution, and crimes requiring money, it becomes clear that none of them refers to behavior that continues over time and is intended to be realized until the criminal behavior ceases. have not had The current research, with descriptive-analytical method, will criticize the continuity of continuous crime and consequently, the inclusion of the subsequent law with a more severe punishment than the mentioned crime in the light of Article 10 of the Islamic Penal Code, the principle of interpretation in favor of the accused and Imami jurisprudence, until there is no continuous crime. and prove its opposition to the principle of innocence. In this regard, it is necessary to scrutinize the nature of the continuous crime as one of the rare cases of violation of the accused's rights.
