خلاصة:
این پژوهش تلاش میکند تا ضمن تبیین همهی ابعاد بانکداری بخش خصوصی در مبانی نظری، حضور بانکهای خصوصی را در اکوسیستم بازار پول کشور درحال توسعهای چون جمهوری اسلامی ایران، مورد آسیبشناسی و نقد قراردهد. بدین منظور ابتدا چالشهای فقهی-حقوقی و چالشها و آسیبهای اقتصادی-مالی بانکهای خصوصی با بهرهگیری از روشهای تحلیلی و پیمایشی استخراج شده؛ سپس با هدف تایید نهایی و رتبهبندی چالشها از روش دلفی سهمرحلهای استفاده خواهدشد. در دورهای اول و دوم تکنیک دلفی جهت اطمینان از تایید نهایی چالشها و آسیبهای شناسایی شده توسط خبرگان از آزمون آماری دوجملهای استفاده نموده و در دور سوم دلفی برای رتبهبندی چالشهای تایید شده از آزمون رتبهبندی فریدمن بهرهخواهیمبرد. یافتههای این تحقیق نشان میدهد که "عدم توجه نهاد ناظر و قانونگذار در بازار پول به اقتضائات بخش خصوصی در صنعت بانکداری" و "شبههی صدق قواعد "لا ضرر" و "تسبیب" در فقه اسلامی در رابطه با موضوع اضافه برداشت بانکهای خصوصی از بانک مرکزی" بعنوان مهمترین چالشهای فقهی-حقوقی از دیدگاه خبرگان بانکداری کشور بشمار میآید؛ همچنین از نظر کارشناسان خبره صنعت بانکداری "ناکارآمدی در تخصیص منابع" نیز مهمترین آسیب اقتصادی-مالی بانکداری بخش خصوصی در بازار پول ایران بوده که نقش مهمی در ناترازی و تحمیل زیان به شبکه بانکی کشور دارد. راهاندازی سامانه جامع نظارت پویا بر فرآیند تخصیص اعتبارات، تدوین دستورالعمل اضافهبرداشت بانکها از بانک مرکزی، بازنگری در آیینامههای اجرایی مربوطه با هدف تبیین صریح اقتضائات خصوصیسازی در نهادهای پولی و بیان تمایزات آن با دیگر بنگاههای اقتصادی و بکارگیری سیاستهای اعتباری-مالیاتی جهت موجّه و بهصرفه نمودن فعالیت در صنعت بانکداری برای بخش خصوصی از جمله پیشنهادات و رهنمودهای سیاستی ارائه شده است که میتواند آسیبها و چالشهای یادشده را کاهش داده و مدیریت و کنترل نماید.
This study tries to explain and critique the presence of private banks in the developing money market ecosystem of a developing country such as the Islamic Republic of Iran, while explaining all aspects of private sector banking in theoretical foundations. For this purpose, first the jurisprudential-legal challenges and economic-financial challenges and damages of private banks have been extracted by using analytical and survey methods; Then, with the aim of final approval and ranking of challenges, the three-stage Delphi method will be used. In the first and second rounds of the Delphi technique, the binomial test is used to ensure the final confirmation of the challenges and injuries identified by the experts, and in the third round of Delphi, the Friedman ranking test is used to rank the approved challenges. The findings of this study show that "the lack of attention of the regulator and legislator in the money market to the needs of the private sector in the banking industry" and “the possibility of jurisprudential rules of prohibition of Darar & Al-Tasbib on the case of private banks’ over draft from the central bank” are considered as the most important jurisprudential-legal challenges from the perspective of the country's banking experts. Also, according to experts in the banking industry, "inefficiency in resource allocation" is the most important economic-financial damage of private sector banking in the Iranian money market, which has an important role in imbalance and loss of the country's banking network.
