مصادیق الزام به رعایت اصل حسن نیت در حقوق مدنی افغانستانخداداد حکیمی چکیدهاصل حسن نیت از اصولی است که امروزه در حقوق داخلی کشورها و در اسناد بین المللی اهمیت زیادی پیدا کرده است. این اصل در مباحث مربوط به حقوق قراردادها نظر به تحول و تنوعی که یافته است، از اهمیت مضاعف برخوردار است. اصل حسن نیت در مفهوم نوین به معنای صداقت و درستکاری است اما در مفهوم سنتی به خطا و اشتباه تعبیر میگردد. این نگارش در پی بررسی توصیفی-تحلیلی مصادیق اصل حسن نیت در حقوق افغانستان است. یافتهها نشان میدهد که در حقوق افغانستان اصل نامبرده در هر دو مفهوم سنتی و نوین آن به طور گسترده کاربرد دارد؛ حسن نیت در مفهوم نوین بیشتر بر قراردادها حاکم است. بر بنیاد آن، طرفین تعهد مییابند که در مراحل مختلف روابط قراردادی خویش رفتار صادقانه و قابل قبول پیشه نمایند. برای نقض حسن نیت به این مفهوم، ضمانت اجراهای مشخصی وجود دارد. مفهوم سنتی حسن نیت اما جنبه حمایتی داشته و کمتر به قراردادها ناظر است. در این راستا، اشخاصی که در روابط حقوقی به موجب خطا و اشتباه متحمل زیان میگردند، قانونگذار جبرانهای را پیش بینی نموده است. واژگان کلیدی: اصل حسن نیت، مفهوم نوین، مفهوم سنتی، قرارداد، حقوق افغانستان.
Abstract:Khudadad hakimi 1The principle of good faith is one of the principles that has gained great importance in domestic laws of countries and international documents today. This principle, due to the evolution and diversity it has undergone in the issues related to contract law, is of multiple importance. In the modern concept, the principle of good faith means honesty and fairness, but in the traditional concept, it is interpreted as a mistake or error. This writing is a descriptive-analytical study of the examples of the principle of good faith in Afghan law. The findings show that the principle is widely used in both traditional and modern concepts in Afghan law, and in the modern concept, it is more applicable to contracts. Based on this, the parties undertake to behave honestly and acceptably in various stages of their contractual relationships. There are specific performance guarantees for violating good faith in this sense. The traditional concept of good faith, however, has a protective aspect and is less applicable to contracts.
