چکیده:
در این مقاله منابع ایجاد مهر در حقوق اسلامی وهمچنین، موضوع تاسیسی بودن یا امضایی بودن آن واینکه در چه مواردی مهر بر عهده مرد قرار می گیرد، سپس علت وجودی مهر در شریعت اسلام و قانون مدنی ایران ونهایتا، مقدار آن بررسی می شود. حاصل بحث این است که مهر نهادی است امضایی که قبل از اسلام هم وجود داشته است. راجع به فلسفه وجودی آن، نظرات متفاوتی ارائه شده که هیچ کدام قاطع نیست. منابع آن در شرع اسلام، عبارتند از: قرآن،سنت واجماع. فقهاء اسباب تعلق مهر را عبارت از عقد صحیح ، عقد فاسد به شرط دخول، ودخول به شبهه می دانند؛ اما قانون مدنی سخنی از دخول به شبهه نگفته است. مقدار مهر، نه در شرع معین شده است نه در قانون، اما برخی از فقها تعیین مقدار مهر به بیش از مهر السنه را جایزنمی دانند. در پایان، به این نتیجه رسیده ایم که نهاد مهر، نهادی مفید است که ازآن به شکل نادرستی استفاده می شود وقانونگذار باید در این خصوص دخالت کرده وبا وضع قیود یا انجام اصلاحاتی، این نهاد مفید را از این افسار گسیختگی خارج کند.
In this essay we will study the sources of dower in the Islamic law ؛ and if the institution of dower has been created initiatively by Islam or it has existed previously and Islam has confirmed it? And in which cases men are charged with dower? What is the philosophy of dower in the Islamic law and the civil code of Iran? And what is its quantity?
The result of this study is that dower is an institution existing before Islam. It has been presented different views about its philosophy، but none of them is decisive. Its sources in Islamic law are Quran ؛ the tradition (sonnat) and the consensus of opinions (Ijma). Islamic jurist’s view is that the causes of dower are correct contracts، invalid contracts provided that penetration has been happened، and doubtful penetration ؛ but the civil code has not mentioned the recent. Neither in the Islamic law nor in the civil code، the quantity of dower has not been appointed.
But some of Islamic jurists do not permit dower with quantity more than dower of the prophet’s daughter and women. (Mahrossoneh). At the end we have concluded that the institution of dower is a useful one which is applied badly ؛ and the legislator must interfere and discharge this useful institution from this libertinage by enacting some reservations or corrections.
