چکیده:
موضوع پژوهش حاضر بررسی مهمترین مسئولیتهای حقوقی دایه با توجه
به مبانی فقهی و حقوقی آن میباشد. دایه، زنی که به جای مادرء نگهداری و
پرورش نوزاد را بر عهده میگیرد و معمولا او را با شیر خود تغذیه میکند. با
آنکه نگهداری از نوزاد و شیردهی به او عملا و نیز به لحاظ حقوق دو کار مجزا
تلقی میشده، همواره ترجیح این بوده است که دایه، مرضعه نوزاد نیز باشد.
امروزه به شخصی که در نگهداری کودک به مادر کمک میکند پرستار کودک
میگویند. همان طور که در تحقیق حاضر بیان شده استخدام دایه از گذشتههای
دور و پیش از اسلام در جوامع اسلامی معمول بوده و انگیزههای متعددی برای
استخدام دایه وجود داشته است. در دوران جدیدهء اما همراه با تغییر شرایط
اجتماعی، امور نگهداری، حضانت و شیردهی نوزادان و کودکان» ساختار حقوقی
و فرهنگی متفاوتی یافت.
یافتههای پژوهش حاضر نشان داد که عملکرد حقوقی پرستاران کودک
(یا همان دایهگان قدیم) را میتوان در چارچوب مسئولیت مدنی و کیفری پرستاران متخصص ارزیابی نمود. به این ترتیب، چنانچه نوزاد یا کودکی به واسطه تخلفات و خطاهای تشخیصی، درمانی و مراقبتی و ... یک پرستار کودک، دچار آسیب جسمی یا روانی شود، فرد پرستار، به طور مستقیم و غیرمستقیم مسئول تقصیرات خواهند بود. همچنین اگر در صورت غفلت، عدم مهارت و سهل انگاری در فرآیند نگهداری و مراقبت از نوزاد یا کودک، خسارت و آسیبی ایجاد شود، فرد پرستار، ملزم به جبران خسارات وارده خواهد بود.
The subject of this research is review of the most important legal responsibilities nursemaid according to their jurisprudence and legal foundations. A woman who takes care of the baby instead of the mother and she usually feeds him/her with her milk. Although maintenance baby and breastfeeding him/her practically and legally consider as two distinct works but it has always been preferred that nursemaid is also Merzeh (a mother who is breastfeeding to baby). Today, a woman who helps the mother to keep baby known as a nursemaid. In the present study stated, from the distant past, before the advent of Islam, recruiting nurses was a common routine in Islamic societies and there are several motivations for recruiting nurses. In the new era, with changing social conditions, legal and cultural structures relating to maintenance, custody and breastfeeding babies and children has been changed. The
findings of this study showed that legal practice of child nurses can evaluate in the framework of Civil and Criminal Responsibility of specialist nurses. In this way, if a baby or child damages psychological and physical, because of irregularities and diagnostic, medical and careful errors which are done by a nurse, so, the nurse would be directly and indirectly responsible for the guilt’s. Also, if in case of neglect, lack of skill and negligence in the maintenance of the baby caused damages, she will have to compensate for the damages and losses.
