چکیده:
قانون زکات در سال 1390 به تصویب مجلس شورای اسلامی و تأیید شورای نگهبان رسید. با توجه به اهمیت زکات و نقش آن در فقرزدایی، انتظار میرود نقاط قوت و ضعف این قانون مورد مداقه قرار گرفته و سیر تکاملی خود را بپیماید. پژوهش حاضر، ضمن فهرست برخی مزایای قانون زکات، سعی دارد با روش تحلیلی ـ توصیفی، این قانون را در قالب سه محور ارزیابی کند و زمینه را برای رفع نقایص احتمالی و ارتقای آن فراهم سازد. این محورها عبارتاند از: الف) ارزیابی ساختاری: مانند ابهام در شخصیت حقوقی شورای زکات، عدم توجه الزام اعضای آن به تکلیف مشخص، ابهام در وضعیت نهادهای همسو در تداخل مسئولیتها، عدم توجه به زیرساختهایی مثل سامانه جامع اطلاعات، دستگاه نظارتی و مرجع رسیدگی به دعاوی؛ ب) ارزیابی روشی: مانند عدم تبیین مفاهیم و اهداف زکات و وظایف مؤدیان، نظام تشویقی نامتناسب و زمینهساز مفاسد، عدم توجه به الزامات سایر ادیان و مذاهب؛ ج) ارزیابی محتوایی: مانند لزوم هدفمندی کمکهای دولت، فقدان وحدت رویه اعضا در شوراهای محلی و لزوم تعیین وظایف مؤدیان.
The Zakat Law was passed in 2011. Given the importance of Zakat and its role in poverty alleviation، it is expected that the strengths and weaknesses of this law will be taken into account and will continue to evolve. The present study، along with a list of some advantages of the Zakat law، attempts to use the descriptive analytical method to evaluate the law in the form of a three-axis evaluation and a framework for eliminating potential defects and promoting them. These axes include: (a) structural assessment، such as ambiguity in the legal personality of the Zakat council; the lack of consideration of the obligation of its members to the specific task; the ambiguity of the status of the entities in the interfacing of responsibilities; the lack of attention to the infrastructure such as the comprehensive information system، the monitoring and reference system Litigation (B) methodological assessment، such as the lack of clarification of the concepts and objectives of zakat and the duties of the clergymen، the disproportionate incentive system and the creation of corruptions; the lack of respect for the requirements of other religions and religions. (C) Content evaluation، such as the need for targeted targeting
